    OKLAHOMA CITY — Gov. Kevin Stitt has signed into law a yearlong ban on student cellphone use in all Oklahoma public schools.

    Oklahoma will join 11 other states that have implemented similar statewide restrictions. Some school districts in the state enforce a similar policy already.

    Stitt signed Senate Bill 139 on Monday to implement the “bell to bell” ban for the 2025-26 school year. The restriction becomes optional for districts in the 2026-27 school year and thereafter.

    While the yearlong ban is in place, each district’s school board must adopt a policy restricting students from using cellphones, laptops, tablets, smart watches, smart headphones and smart glasses from the first bell ringing in the instructional day until final dismissal. The policy must outline disciplinary procedures for enforcing the rule.

    School-issued or school-approved devices used for classroom instruction are still allowed under the law. Districts could permit cellphone use for emergencies and for students who need it to monitor a health issue.

    Stitt previously urged public schools to find cost-neutral ways to make classrooms cellphone free to reverse a “worrying trend” of distraction, bullying and learning difficulties.

    “We’re seeing classrooms across the country struggle with the influx of cellphone use by students,” Stitt said in a statement Tuesday. “That’s why I issued my cellphone free school challenge in the fall. We want kids to be focused and present while they’re with their teachers, and this legislation helps promote an environment conducive to learning.”

    Before the 2025 legislative session began, state lawmakers met with mental health researchers who warned about the negative effect and addictive impact of digital media on youth. They also spoke with Oklahoma educators who said their schools saw better student behavior after banning cellphones.

    Meanwhile, Stitt visited schools that already have these restrictions in place, where students and educators spoke favorably about their school rules.

    Among the nation’s largest teachers union, 90% of members said they support cellphone restrictions during class time, and 83% favored prohibiting cellphone and personal device usage for the entire school day, according to a National Education Association survey.

    U.S. adults reported broad support for classroom cellphone restrictions in middle and high schools, but only a third of American adults said they support extending these bans for the whole school day, the Pew Research Center found.

    Support for SB 139 wasn’t overwhelming among Oklahoma lawmakers, either. The state Senate passed the bill with a 30-15 vote, and the House approved it 51-39.

    The House also passed a similar school cellphone ban, House Bill 1276, that would allow districts to opt out of the policy. SB 139 allows no such option until after a year.

    “This will allow teachers to focus entirely on educating our kids while students can concentrate on learning as much as possible,” an author of both bills, Sen. Ally Seifried, R-Claremore, said. “After two years of hard work on this issue, I’m thrilled to see this legislation become law, and I’m confident students, parents and teachers will see immediate benefits once the new school year begins.”

    HB 1276 is unlikely to advance in the Senate now that SB 139 has the governor’s signature, Seifried said.

    The bill’s House author, Rep. Chad Caldwell, R-Enid, called the measure a “try it before you buy it type of policy.”

    “I appreciate Gov. Stitt signing SB 139 to remove the distractions of cellphones from our schools and give our kids their childhood back,” Caldwell said Tuesday.

    The governor on Monday also signed into law a restriction on virtual school days. Senate Bill 758 will limit districts to using a maximum of two online instruction days per school year.

    “Kids learn best in the classroom,” said Sen. Kristen Thompson, R-Edmond, who wrote the bill. “Virtual days have their place in emergencies, but we’ve seen them become a go-to solution in some districts — and that’s not fair to students or families. This bill strikes the right balance by preserving flexibility without compromising the quality of education.”

    Last week, the Supreme Court held oral arguments in a case that could undermine public education across America. The question the court is looking to answer is whether a religious institution may run a publicly funded charter school — a move that would threaten not only the separation of church and state, but the right of every student to access free, high-quality learning.

    In 2023, Oklahoma’s Statewide Virtual Charter School Board approved St. Isidore of Seville Catholic Virtual School, an action that would make it the nation’s first-ever religious charter school. It would be governed by Catholic religious doctrine in its syllabus, operations and employment practices. It would use taxpayer dollars to pay for religious instruction. And it could turn away students and staff if their faith or identity conflict with Catholic beliefs. 

    Here’s the issue: Charter schools were created to be public schools. They are open to all students, from every background, tradition and faith community. They are publicly funded and tuition-free. And they are secular. 

    That’s not an arbitrary distinction – it’s a constitutional one, grounded in the law and embedded in charter schools’ very design. The First Amendment’s Establishment Clause bars the government from promoting or endorsing any religion through public spaces or institutions. This foundational rule has ensured that students of all backgrounds can access public schools. It does not stifle religious expression — the Constitution fully protects this freedom, and religious education is available in other venues. Personally, I was, in fact, educated at Jesuit Catholic schools for my entire academic career. 

    Parochial education has long been an accepted and important part of the education ecosystem, serving a variety of students and often filling an important need. Religiously affiliated schools have a long history of educating and caring for children who are new to this country and underserved, and supporting families who are overlooked. But promoting the exclusive teachings of a specific religion with public funds in a public school violates a clear constitutional principle. 

    The issue isn’t only a legal matter; it’s about the character of public education itself. Muddying the boundary between public and religious institutions would undercut a fundamental commitment made by the nation’s public charter schools: that they are accessible to every student. It would undermine legal protections that keep public services available to the public. 

    Rather than creating more opportunities for America’s students, it would constrict opportunities for a high-quality education, especially in states that are hostile toward charters or alternative public school models. Legislative bodies could seek to eliminate funding for all unique school types if the court decision forced them to fund religious schools operating with public dollars. This would curtail or dismantle strong independent schools, 30-year-old public charter schools and schools with unique programs designed for special populations.

    As executive director of the DC Charter School Alliance, and a long-time public charter school advocate, I’ve seen the importance of public charter schools firsthand. Here in the District of Columbia, charter schools serve nearly half of the public school students in the city. Outstanding educators from all walks of life teach a wide range of subjects with enthusiasm and expertise to prepare young people for success. Our students bring to the classroom an incredible range of experiences, including faith traditions. And every student, family and faculty member is welcome. D.C.’s charter schools reflect a core American value: the promise of a high-quality public education for all. 

    The justices of the Supreme Court face a clear and critical choice: They can bolster that promise, or they can tear it down. If the court allows a religious school to operate with public funds, there is no doubt that it will open the floodgates to other proposals across the country. Taxpayers could be forced to foot the bill for countless new and converted schools, draining resources from an already financially strapped education system. True public charter schools — the ones committed to high standards, positive results and opportunity for all — could bear the cost. And the students who rely on them could suffer. 

    Public education is one of America’s most vital institutions. It offers all children, no matter their background or beliefs, access to free, high-quality learning. Charter schools play an essential role in making that promise real. But allowing a religious school to operate with public funds turns public education into something much more restrictive, dismantling its very foundation.

    The court must reaffirm this indisputable truth: Public schools should remain public — and open to all.

    OKLAHOMA CITY – A bill that would ban schools from using corporal punishment on students with disabilities passed the Senate on Tuesday despite concerns it removes local control and could go against parental wishes.

    The state Department of Education has already prohibited the practice, but Senate Bill 364 seeks to codify into state law a ban against deliberately causing pain by using physical discipline on students with federally protected disabilities.

    “I have never, ever, ever met a parent of a disabled child call for the beating of their child to make them better,” said Sen. Dave Rader, R-Tulsa, the author.

    Rader said some of the protected disabilities include deafness, emotional disturbance, intellectual disability, visual impairment or an orthopedic injury.

    It defines corporal punishment as the deliberate infliction of pain by hitting, paddling, spanking, slapping, or any other physical force used as a means of discipline.

    Rader said corporal punishment could not be used by a school even if a parent agreed to it.

    “Perhaps the parent of the child, in most cases, knows best what that child is going to respond to and how the child is going to perform his or her duties in the classroom,” said Sen. Warren Hamilton, R-McCurtain, who voted against the bill.

    A U.S. Supreme Court ruling in 1977 allows corporal punishment usage in schools, but leaves it to states to set their own rules.

    Traditionally, Oklahoma lawmakers have left those decisions to local districts, but the state Department of Education quietly barred the practice on children with disabilities starting in the 2020-21 school year. A 2017 law also prohibits the practice on children with the most “significant cognitive disabilities.”

    During the 2017-18 school year, over 20% of  corporal punishments in Oklahoma schools were administered on disabled children, according to federal statistics.

    Other forms of discipline are available, Rader said. The bill does not prohibit parents from using corporal punishment, Rader said.

    Previous efforts to ban the practice have proven controversial. A similar effort last year cleared the state Senate, but died in the House.

    Sen. Shane Jett, R-Shawnee, said Tuesday that banning the practice in schools amounts to “a top down socialist aligned ideological, unilateral divorce between parents’ ability to collaborate with their local schools to establish a disciplined regimen.”

    He also said it “is a violation of scripture,” and cited Proverbs 22:15 which he said says “folly is bound up in the heart of a child, but the rod of discipline drives it far from him.”

    “There are going to be times when we walk through the valley of the shadow of death, we won’t have to fear evil because your rod and your staff comfort me,” Rader responded.

    Sen. Dusty Deevers, R-Elgin, said there could be negative consequences to removing a partnership between parents and local administrators and forcing the removal of a historically necessary and important disciplinary tool for order.

    “This is not a blanket ban,” Rader said.

    The vote was 31-16.

    The measure moves to the House for possible consideration.

    OKLAHOMA CITY — As state officials anticipate a smaller budget in the next fiscal year, lawmakers on Tuesday appeared doubtful of requests to spend millions on Bibles for public schools and salary increases at the Oklahoma State Department of Education.

    The agency’s leader, state Superintendent Ryan Walters, again asked for $3 million to purchase copies of the Bible, the Declaration of Independence and the U.S. Constitution to place in every public school classroom. He also requested $2.3 million for a 6% cost-of-living salary bump for Education Department employees, who last saw a pay raise in 2019.

    Although his total budget request would increase the agency’s funding by $113 million, Walters hinted at “potential staff cuts” to limit the Education Department’s operational expenses during a meeting Tuesday with the Senate Appropriations Committee.

    “I​​ do believe we can save $1.3 million in some of the costs that we’ve been able to absorb through rolling positions together, cutting positions that are duplicated in their services,” Walters said during the meeting.

    Members of the influential appropriations committee heard Walters’ budget requests for the 2026 fiscal year. The state is required to pay some of the projected expenses, such as an extra $88.6 million for the rising cost of health insurance for public school employees.

    Another $4 million would increase the teacher maternity leave fund, which Walters said is growing in popularity. He also asked for $500,000 to offer firearms training to teachers.

    Senators of both parties questioned Walters’ request for $3 million to buy 55,000 copies of the King James Version Bible, which they suggested could be donated to schools or found for free online.

    House lawmakers had similar questions during a hearing with Walters last week.

    The state superintendent has advocated for more instruction on the Bible to help contextualize American history and the beliefs of the country’s founding fathers. He said he doesn’t intend for schools to preach Christianity to students.

    Last year, he ordered all school districts in the state to incorporate the Bible into their lesson plans and proposed new academic standards for social studies that would mandate instruction on biblical stories. His agency already spent under $25,000 on 532 copies of Lee Greenwood’s God Bless the USA Bible, which is informally known as the Trump Bible because it has the president’s endorsement.

    Walters’ Bible instruction mandate already faces a legal challenge on church-state separation grounds.

    Sen. Brenda Stanley, R-Midwest City, said she never encountered a classroom that didn’t have a Bible available to students during her 43-year career in education.

    Sen. Dave Rader, R-Tulsa, encouraged Walters to exhaust all resources for Bible donations before having the Legislature consider spending $3 million.

    “We could take the $3 million elsewhere, if somebody is willing to make those available to us at no cost,” Rader said during the hearing.

    The Senate committee also appeared dubious of funding a COLA increase for an agency that has lost dozens of employees over the past two years. Walters told the committee the Education Department employed 520 people when he took office in January 2023 and that it now counts 460 employees.

    “If you have decreased your (full-time employees), it would appear to me that there are already dollars inside your operating budget to offer salary increases,” Sen. Kristen Thompson, R-Edmond, told Walters during the hearing.

    Walters disagreed that staff departures would be enough to fund the increase. A complicating factor is the large number of federally funded salaries at the agency, he said.

    The department has considered reducing its staff even further after the state Board of Equalization projected the Legislature will have $119 million less to spend in the 2026 fiscal year, Walters said.

    The projection is preliminary, and the Board of Equalization will meet again this month for updated numbers.

    “After the last Board of Equalization meeting, we really went in and tried to do a deep dive into can we continue to see cuts, and we believe that we do need to be able to do that,” Walters said.

    Legislative leaders are preparing to limit expenses in light of the budget projections, especially as Gov. Kevin Stitt pushes for further tax cuts, flat agency budgets and “eliminating wasteful government spending.”

    The governor suggested no funding increases to public schools nor to the state Education Department in a budget proposal he released Monday.

    House Speaker Kyle Hilbert, R-Bristow, said Monday that he shares many of the governor’s priorities “as we seek to tighten our belt fiscally this year.” Senate President Pro Tem Lonnie Paxton, R-Tuttle, echoed Stitt’s tax-cut message when he endorsed “improving the lives of Oklahomans by allowing them to keep more of their hard-earned money.”

    OKLAHOMA CITY — Oklahoma lawmakers filed hundreds of bills affecting education for the next legislative session.

    Oklahoma Voice collected some of the top trends and topics that emerged in legislation related to students, teachers and schools. The state Legislature will begin considering bills once its 2025 session begins Feb. 3.

    Bills would restrict minors’ use of cellphones and social media

    As expected, lawmakers filed multiple bills to limit student cellphone use in public schools, an issue that leaders in both chambers of the Legislature have said is a top priority this year.

    The House and Senate each have a bill that would prohibit students from using cellphones during the entire school day. Some Oklahoma schools already made this a requirement while others allow cellphone access in between classes.

    After encouraging all districts to establish cellphone restrictions, Gov. Kevin Stitt visited multiple schools in November that have done so.

    Senate Bill 139 from Education Committee vice chair Sen. Ally Seifried, R-Claremore, would require all districts to ban students from accessing their cellphones from the morning bell until dismissal, and it would create a $2 million grant program to help schools enact phone-free policies.

    Legislation from a House leader on education funding, Rep. Chad Caldwell, R-Enid, would prohibit student cellphone use while on school premises.

    Multiple bills target children’s social media use. Sen. Kristen Thompson, R-Edmond, aims to ban social media accounts for anyone under 16 with SB 838 and, with SB 839, to deem social media addictive and dangerous for youth mental health. 

    A bill from Seifried would outlaw social media companies from collecting data from and personalizing content for a minor’s account, which a child wouldn’t be allowed to have without parent consent

    SB 371 from Sen. Micheal Bergstron, R-Adair, would require districts to prohibit the use of social media on school computers or on school-issued devices while on campus. SB 932 from Sen. Darcy Jech, R-Kingfisher, would allow minors or their parents to sue a social media company over an “adverse mental health outcome arising, in whole or in part, from the minor’s excessive use of the social media platform’s algorithmically curated service.”

    School chaplain bill reemerges

    Multiple lawmakers have refiled a bill seeking to enable religious chaplains to counsel students in public schools. A version of the controversial bill passed the House last year but failed in the Senate.

    Its original author, Rep. Kevin West, R-Moore, refiled it as House Bill 1232. Sen. Shane Jett, R-Shawnee, and Sen. Dana Prieto, R-Tulsa, filed similar school chaplain bills with SB 486 and SB 590.

    More restrictions suggested for sex education, gender expression

    Another unsuccessful bill returning this year is legislation that would have families opt into sex education for their children instead of opting out, which is the state’s current policy.

    Students wouldn’t be allowed to take any sex education course or hear a related presentation without written permission from their parents under SB 759 from Prieto, HB 1964 from Danny Williams, R-Seminole, and HB 1998 from Rep. Tim Turner, R-Kinta.

    Sen. Dusty Deevers, R-Elgin, would have any reference to sex education and mental health removed from health education in schools with SB 702.

    Prieto’s bill also would exclude any instruction about sexual orientation or gender identity from sex education courses. It would require school employees to notify a child’s parents before referring to the student by a different name or pronouns.

    Other bills similarly would limit students’ ability to be called by a different name or set of pronouns at school if it doesn’t correspond to their biological sex.

    Deevers’ Free to Speak Act would bar teachers from calling students by pronouns other than what aligns with their biological sex or by any name other than their legal name without parent consent. Educators and fellow students could not be punished for calling a child by their legal name and biological pronouns.

    Rep. Gabe Woolley, R-Broken Arrow, filed a similar bill.

    No public school could compel an employee or volunteer to refer to a student by a name or pronoun other than what corresponds with their sex at birth under SB 847 from Sen. David Bullard, R-Durant, nor could any printed or multimedia materials in a school refer to a student by another gender.

    Corporal punishment in schools

    Once again, Oklahoma lawmakers will consider whether to outlaw corporal punishment of students with disabilities. State law currently prohibits using physical pain as discipline on children with only the most significant cognitive disabilities.

    In 2020, the state Department of Education used its administrative rules to ban corporal punishment on any student with a disability, but similar bills have failed to pass the state Legislature, drawing frustration from child advocates.

    Sen. Dave Rader, R-Tulsa, was an author of last year’s bill to prohibit corporal punishment of students with any type of disability. He filed the bill again for consideration this session.

    HB 2244 from Rep. John Waldron, D-Tulsa, would require schools to report to the Oklahoma State Department of Education the number of times they administer corporal punishment along with the age, race, gender and disability status of the students receiving it. The state Department of Education would then have to compile the information in a report to the Oklahoma Commission on Children and Youth.
