    Our Debate Over Higher Ed Has Lost the Plot (opinion)

    There is an endless war being waged against colleges and universities in this country, one unprecedented in our lifetimes. Not merely a war of words, it is one of deeds. Beginning with state-level efforts to ban “critical race theory” and “divisive concepts” from college classrooms and diversity, equity and inclusion initiatives from campuses, it has now grown into an obsessive preoccupation of federal policy.

    Broad executive orders have sought to ban concepts related to race, gender and identity on campus, using the leverage of withheld federal grants. Drastic and indiscriminate cuts have been made to university funding. International students have had their visas revoked on the basis of their political views. Attacks on nonpartisan university accreditors have mounted. And escalating demands that elite private research universities effectively place themselves in government receivership or lose further billions in federal dollars have thrown the sector into chaos.

    That is why I was honored to sign, and to help coordinate, last month’s letter from more than 600 college, university and scholarly society presidents in defense of our nation’s institutions of higher learning. The letter, which calls for “constructive engagement that improves our institutions and serves our republic,” also criticizes “the unprecedented government overreach and political interference now endangering” institutions of higher learning and warns that “the price of abridging the defining freedoms of American higher education will be paid by our students and our society.”

    I remain concerned that the problems colleges and universities face today go deeper than funding cuts and government threats. Indeed, our national debate over higher education has lost the plot entirely. Critics of higher education present the entire sector as an elitist, out-of-touch indoctrination factory for liberal orthodoxy, one that has replaced the great books of the Western canon with political claptrap. This charge has gained broad traction among the public. But not only is it untrue on the merits, it fundamentally misunderstands the purpose and mission of higher education. It asks the wrong question and delivers the wrong answer.

    If our sector is to regain the respect and appreciation of American society, we need to reorient the national conversation. We need to help people remember what it is that colleges and universities actually do—and why it matters.

    The American Association of Colleges and Universities, where I have been president since 2016, is a voice and a force for what we call liberal education. Let me be clear: teaching students to believe in liberal politics or conservative politics is the opposite of what “liberal education” means. Rather, the term, which predates modern political labels, refers to liberating the mind from received orthodoxies of all types.

    I agree with Margaret Mead—and with leaders across the political spectrum, from Barack Obama to Ron DeSantis—that students should be taught how to think, not what to think. A successful college education is measured not by what its graduates believe but by what they can conceive. It fires the imaginations of its students, helps them explore ideas and experiences different from their own, and trains them in habits of thought and mind that aid them in making their own meaning from the world. It provides them both with the practical skills they will need for their future employment and with the critical thinking tools that help them attain, and succeed in, their jobs of choice. By providing a forum and a method for open inquiry and intellectual freedom, and by exposing students and communities to new ideas and perspectives, it also helps to strengthen our democracy.

    This type of education does not happen by chance, from a hodgepodge of unconnected courses; it is part of a plan. For decades, AAC&U has served as a learning lab for a type of comprehensive undergraduate education that teaches students in a systematic way, over the course of a two-year or four-year degree, how to become effective thinkers and problem-solvers. We pioneered the concepts of high-impact practices, inclusive excellence and innovations in general education, learning outcomes and assessment, innovations that have been adopted by hundreds of campuses across the country, including many of our nearly 900 member institutions.

    Higher education should always try to do better at opening students’ minds; in fact, that commitment is at the core of my organization’s work. Taking criticism seriously is how colleges and universities innovate and improve. But that innovation cannot happen if the government steps in to ban or defund ideas it dislikes, taking away the academic freedom of faculty; if it strips university leadership of its autonomy to make decisions about what ideas are permitted or promoted on campus; or if it makes so many threats or cuts that professors and students become afraid to speak and think freely.

    The careful process of preparing students for democratic citizenship requires helping them understand the great multiplicity of people, cultures and beliefs that make up the world we live in. It is time for us to stop asking whether colleges and universities teach the “right” ideas and ask, instead, whether they teach students the skills they need to navigate our complex world. That approach would lead us away from culture wars and heavy-handed government restrictions and toward constructive engagement with the educational missions of colleges and universities so they can work together with government to improve our students’ educations.

    Higher education can cut through the immigration debate with a focus on quality

    The surge for Reform in the recent local elections in England has increased fears in the higher education sector that Labour may feel compelled to focus on driving down immigration at the expense of its other priorities and missions – James Coe has set out the risks of this approach on Wonkhe.

    Vice chancellors are understandably frustrated with the public debate on immigration and do not relish the prospect of rehearsing the same political cycle in the wake of the forthcoming white paper on legal migration. All can reel off data point after data point demonstrating the value of international student recruitment to their regions and communities, which according to the most recent London Economics calculations for the academic year 2022–23 brought £41.9bn a year in economic returns to the UK. That data is well supported by polling that suggests the public is generally pretty unfussed about international students compared to other forms of legal migration. The latest insight from British Future on the public’s attitudes to international students found:

    International students are seen to boost the UK economy, fill skills gaps, improve local economies and create job opportunities for locals and make cities and towns more vibrant and culturally diverse.

    Heads of institution also add that of all the many and varied problems and complaints that arise from engagement with their local communities and regions, international students have never once featured. The problem, they say, is not policy, it is politics. And when politics tilts towards finding any means to drive down overall migration, higher education inevitably finds itself in the position of being collateral damage, despite the economic and reputational harm done – because it’s much easier to reduce student numbers than to tackle some of the more complex and intransigent issues with immigration.

    Standing the heat

    To give the government its due, the signal it wants to send on student visas is not currently about eroding the UK’s international competitiveness as a destination for study, and much more about reducing the use of that system for purposes for which it was never designed, particularly as a route to claiming asylum. Measures proposed are likely to include additional scrutiny of those entering from Nigeria, Pakistan, and Sri Lanka, an approach that may sit uncomfortably as making broad assumptions about a whole cohort of applicants, but at least has the benefit of being risk-based. That nuance may be lost, however, in how the public conversation plays out both within the UK and in the countries where prospective international students and their governments and media pay close attention to the UK international policy landscape and associated mood music.

    The political challenge is not limited to higher education. Recognising the derailing effect of constant short-term reactive announcements in immigration policy, a number of influential think tanks including the Institute for Government, the Institute for Public Policy Research, the Centre for Policy Studies, Onward, and British Future have called on the government to create an annual migration plan. The Institute for Government’s explanation of how it envisages an annual migration plan would work sets out benefits including clarity on overall objectives for the system with the ability to plan ahead, the segmentation of analysis and objectives by route, and the integration of wider government agendas such as those on skills, or foreign policy.

    For the higher education sector, an annual planning approach could make a big difference, creating space for differentiated objectives, policy measures and monitoring of student and graduate visas – something that in many ways would be much more meaningful than removing student numbers from overall published net migration figures, or presenting them separately. It could open up a sensible discussion about what data represents a meaningful measure, what should be adopted as a target and what should be monitored. It could also open up space for a more productive conversation between higher education representatives and policymakers focused on making the most of the connections between international education, regional and national skills needs, and workforce planning.

    In the weeks and months ahead the government is also expected to publish a refreshed international education strategy, which should give the sector a strong steer about what the government wants to see from international higher education. But it will be critical for that strategy to have a clear line of sight to other government priorities on both the economy and the wider immigration picture, to prevent it being siloed and becoming dispensable.

    The fate of the last government’s international education strategy tells an instructive tale about what happens when government is not joined up in its agenda. Three years ago the sector and its champions in Westminster celebrated the achievement of a core objective of that strategy – attracting 600,000 students to the UK – eight years earlier than planned. But that rapid growth provided both unsustainable, as numbers dropped again in response to external shocks, and politically problematic, as students bringing dependents drove up overall numbers and the government responded with another shift in policy. The credibility and longevity of the refreshed strategy will depend on the government’s willingness to back it when the political heat is turned up in other parts of the immigration system.

    Quality is our watchword

    The higher education sector is justifiably proud of its international offer and keen to work with government on developing a shared plan to make the most of opportunities afforded by bringing students to the UK to study. The focus has to be on quality: attracting well-qualified and capable applicants; offering high-quality courses focused on developing career-relevant skills, particularly where there is strategic alignment with the government’s industrial strategy; and further enhancing the global employability of UK international graduates, whether it’s through securing a good job via the Graduate route, or elsewhere.

    The value of international recruitment is not always very tangible to people living in communities in terms of valuable skills and cultural capital – and that breaks down to telling stories in ways that people can connect with. As one Labour Member of Parliament suggested to us, many parts of Britain are in the process of reimagining their collective identities, and part of the job is building a compelling identity connection with the new economy rather than harkening back to an imagined past. That is work that sits somewhat apart from simply explaining the value of international students, but may also turn out to be intimately connected to it.

    Higher education institutions can work with employers, the regional and national policymakers concerned with skills, innovation and growth, and in local communities, to further that agenda, but they need the breathing space afforded by policy stability and a clear plan from government they can trust will be sustainable. To create that space, the sector will need to demonstrate that it has a high standard of practice and will not tolerate abuse of the system. “Abuse” is a loaded word; many of the practices that raise alarm are technically legal, but they put the system as a whole in jeopardy. The sector has a great track record on developing a shared standard of practice through instruments like the Agent Quality Framework, but it may also need to collectively think through whose job it is to call out those who fall short of those standards, to avoid the whole sector being tarred with the brush of irresponsible practice.

    While the landscape is complicated and at times disheartening, UK higher education can cut through the noise by sticking like glue to its quality message. Many universities are bigger and longer standing than Premier League football clubs – but those bastions of community pride have also had to work through challenges with their places and update their practice as the landscape has shifted. There is an opportunity with the forthcoming white paper and international education strategy to get the government and the sector on the same side when it comes to international higher education. Both parties will need to show willing to hear where the other is coming from to avoid another five years of frustration.

    How standardized tests became part of the DEI debate

    In the Education Department’s sweeping Dear Colleague letter last month, acting assistant secretary for civil rights Craig Trainor wrote that colleges must eliminate all race-conscious programs and policies, from scholarships and admissions practices to campus cultural groups and DEI training.

    One surprising mention: standardized testing policies.

    Trainor wrote that test-optional policies could be “proxies for race” to help colleges “give preference” to certain groups.

    “That is true whether the proxies are used to grant preferences on an individual basis or a systematic one,” he wrote. “It would, for instance, be unlawful for an educational institution to eliminate standardized testing to achieve a desired racial balance or to increase racial diversity.”

    Higher education leaders and researchers have long debated the pros and cons of standardized testing in admissions: Some believe they’re a meritocratic predictor of academic success, while others say they’re more aligned with family wealth. In recent years, those debates have become entangled with discussions of systemic racism in the American education system.

    During the COVID-19 pandemic, the vast majority of colleges waived test requirements for applicants. Five years later, most have retained their test-optional policies—though a year ago some selective institutions began returning to score requirements, reigniting a charged debate about the role of standardized tests in admissions.

    After the Supreme Court banned affirmative action in 2023, experts said test-optional policies could serve as race-neutral measures to help colleges maintain diversity in their applicant pools. They cited research showing that colleges with test-optional policies enrolled 10 to 12 percent more students from underrepresented racial backgrounds; other studies found that doing away with test requirements simplified the application process and thus removed barriers for first-generation and other underserved students. The Biden administration even included test-optional policies in its guidance for colleges adjusting to the court ruling.

    If colleges cited such research in keeping their test-optional policies, Trainor’s letter implied it could be grounds for a civil rights investigation.

    In a Frequently Asked Questions document meant to clarify the broad scope of the Dear Colleague letter, OCR made no mention of testing policies. But in response to multiple questions from Inside Higher Ed about how the department views test-optional policies, Trainor left the door open to federal scrutiny.

    “This isn’t complicated,” he wrote. “When in doubt, every school should consult the [Students for Fair Admissions v. Harvard] legal test contained in the [Dear Colleague letter]: ‘If an educational institution treats a person of one race differently than it treats another person because of that person’s race, the educational institution violates the law.’”

    Harry Feder, executive director of FairTest and an outspoken critic of standardized testing, said assessments like the SAT have long been embroiled in debates about racial equity in education, but the discourse grew more prominent as attacks on DEI and affirmative action intensified.

    “The SAT has racial bias baked into it from its origins as an early IQ test to keep out the riffraff,” he said. “What Republicans are now saying is, that’s an objective measure of merit, and if white and Asian kids do better on them over all, then colleges not considering those scores is a form DEI run amok.”

    John Friedman, an economics professor at Brown University, has published numerous influential studies on the effects of standardized testing policies, including those cited by the majority of Ivy League institutions that decided to return to test requirements. He said he understands where the Education Department’s skepticism comes from.

    “Schools might be tempted to continue test-optional policies to make it easier to maintain diverse classes, even if that makes it harder to assess students’ academic preparation,’” Friedman said. “I think that’s where some of the angst comes from, as part of a larger concern about higher education moving away from the traditional sense of meritocracy.”

    At the same time, he said the department should consider how institutions use test scores in admissions, which can vary widely.

    “The point is not that you can’t go test-optional. It’s that you shouldn’t if your goal is an end run around the SFFA decision,” Friedman said. “It would be bad to force institutions that decided thoughtfully that test requirements are not best for them to adopt those policies anyway.”

    Dominique Baker, associate professor of education and public policy at the University of Delaware, said she doesn’t believe it should matter whether colleges are considering racial diversity in deciding on their testing policies. The truth, she said, is that research on how testing policies affect applicant diversity is murky, and many of the colleges where the policies could have a demonstrable impact have already returned to requiring scores.

    For her, the mention of testing policies alongside other DEI initiatives is “head-scratching.”

    “The places the administration cares about have largely already returned to testing, or are certainly poised to do so soon. So who is this for?” Baker said. “It’s bananas that testing is even in here.”

    Reversing the Test-Optional Tide?

    So far, the letter hasn’t had any effect on institutions’ testing policies. But colleges are starting to respond to the Dear Colleague letter’s guidance in other ways, changing the names of student service offices, scrubbing mentions of race and equity from their websites, eliminating race-conscious programs, and canceling affinity group events.

    “It would be naïve to believe that certain institutions wouldn’t, at the very least, strongly consider changing their testing policies in order to fly under the radar with the administration,” Baker said.

    Some colleges are pushing ahead with their test-optional policies regardless. Last Thursday the University of Vermont announced that its test-optional policy, put in place during the pandemic, would become permanent.

    Jay Jacobs, vice president for enrollment management at Vermont, told Inside Higher Ed the decision was based on years of research that found that removing test requirements not only had little effect on students’ academic performance and persistence, but also helped UVM achieve its goal of enrolling more local and first-generation students.

    He said the university did not take racial diversity into account when measuring the policy’s enrollment impact—“we didn’t want that to be construed as the reason,” he explained—but said that whatever the rationale, he doesn’t believe the Education Department’s guidance should have any influence.

    “No external party should have a say in dictating institutional policy,” Jacobs said.

    Meanwhile, leaders in the assessment industry have remained largely silent about the Trump administration’s promotion of their exams as part of the war on DEI.

    The College Board, which owns and administers the SAT, did not release a public statement about the letter, nor did ACT, Educational Testing Services or any other major assessment organization.

    College Board communications director Holly Stepp wrote in an email to Inside Higher Ed that the organization believes testing can promote college access, but it does not usually comment on policy matters.

    “College Board provides access and opportunity to millions of students from every background through programs that are mission-driven, evidence-based, and nonpartisan,” Stepp wrote. “We do not set policies around how our exam is used by higher education institutions and scholarship providers.”

    Juan Elizondo, ACT’s strategic communications director for government and public relations, told Inside Higher Ed that the company stands behind institutions’ freedom to set their own testing policies.

    “ACT respects the authority of our higher education partners to decide the admission standards that are right for their institutions,” he wrote.

    Failing the Logic Test

    As colleges like Yale, Harvard and MIT returned to test requirements last year, many cited the same new research: a study from Opportunity Insights that found that test-optional policies made it more difficult for selective institutions to admit students who could succeed academically—and to find qualified applicants from diverse racial and economic backgrounds. Statements from both Yale and Dartmouth said that test scores could “help expand access” for underrepresented groups, including students of color.

    So if both test-optional and test-mandatory policies can promote racial diversity depending on the institution, how will the Trump administration enforce its guidance?

    When asked this question, Trainor did not respond directly but implied that any institution using racial diversity as a justification for any policy, or even citing it as a potential benefit, could be in violation of the current Education Department’s views on civil rights law.

    Friedman, one of the researchers who produced the Opportunity Insights study, said his research showed that for some highly selective colleges, requiring test scores could help “a little bit” with diversity in the selection process. The argument is that by providing a standardized measure of academic preparedness, selective colleges can find a “diamond in the rough”—applicants from underresourced high schools who would struggle to stand out otherwise.

    “For some schools, going back to requiring testing may help improve diversity, but my sense is that improving diversity is not the primary motivation behind this policy change,” he said.

    Feder agreed but had a different prediction.

    “If I’m at the OCR and an Ivy League college is saying, ‘We went back to test requirements because it’s good for diversity,’ even if that’s not really the case, I’d go investigate them,” he said. “By their own logic, they’d have to.”

    Baker said there hasn’t been enough research to determine whether test-optional policies make a huge difference in promoting diversity. Many of the colleges that have kept them in place, she said, have also made more holistic changes to their admissions process that could account for diversity gains. But she believes ending the experiment early by government coercion would be a major step backward.

    “Researchers in the field are doing some real deep dives to better understand the effects of test-optional policies themselves. The people writing the [Dear Colleague] letter have no clue about any of that; they just read about how these policies are part of an anti-white war on meritocracy,” she said. “They’re just throwing spaghetti at the wall.”

    An opportunity to reframe the DEI debate (opinion)

    The U.S. Department of Education’s Office for Civil Rights issued a Dear Colleague letter on Friday that instructs college leaders to eliminate any campus activities that directly or indirectly treat students differentially on the basis of race. Others will rightly push back on the logic of the department’s stated justifications, the absurdity of its timing and the accuracy of its examples, but I want to suggest that campus leaders can also take this as an opportunity to enact real change on behalf of all students.

    This is a moment for campus leaders to reframe the terms of the current debate over the legitimacy of special diversity, equity and inclusion programs by doing the long-needed work of truly decentering whiteness as the normative identity and experience within so many campus curricula and co-curricular programs.

    If we are to truly serve our students regardless of race, and if—as the department’s letter states—we have to put an end to even the subtle ways racial preferences and privileges are attached to seemingly race-blind policies, then watch out. Most campuses have a lot of work to do, and much of it is not going to be to the liking of those who believe that it is DEI programs that make an otherwise level playing field an unfair one.

    What the Dear Colleague letter fails to mention is that the proliferation of DEI activities on campuses came about as a more or less conservative compromise position as the population grew more diverse and as students demanded greater access. In treating Black and other minoritized students as “special,” such programs meet the needs of these students in supplementary ways rather than by ensuring that the core curriculum and student life experience are equally useful, meaningful and available to all. If the department insists that we put an end to all DEI programming, then it will also have to support efforts to ensure that whiteness is not smuggled in as the norm or standard.

    Early in my teaching career, I saw the ways that DEI programs could be used to reinforce white centrality rather than challenge it. Student demands for a more representative and accurate curriculum were met with resistance by senior faculty uninterested in expanding their own spheres of knowledge. Special courses in “women’s history” or “Black studies” became the compromise position. Rather than revising the canon to reflect the needs of a curious student body, rather than incorporating new scholarship into the university’s core, rather than interrogating the biases and histories of the curriculum, new courses and departments were created while the original ones were left intact. This détente (you teach yours and I teach mine) became the model.

    Many of the special programs that the Dear Colleague letter seems to have in mind follow this pattern. They keep in place a curriculum and campus culture firmly centered around the interests and perspectives of white students while offering alternatives on the side. If compromise via DEI activities is no longer an option, then a better solution will have to be found. The diversity of the student body is a fact that will still require a reckoning. Decades of scholarship reveal the many ways whiteness is encoded in supposedly neutral policies and programs, and this will not be magically erased. For many colleges, achieving a campus where white students are not unintentionally given extra opportunities based on their race will require radical change.

    My guess is that the department knows this on some level. Otherwise, why is race rather than sex or religion targeted? A sex-neutral campus would have to do away with single-sex housing and sex-segregated sororities and fraternities. A religiously neutral campus could no longer privilege Christian holidays or values.

    We should absolutely fight against the many overt inaccuracies of the Dear Colleague letter. And we should fight against both overt and covert expressions of racism and white supremacy. But we need not fight on behalf of compromise solutions to the very real problems that inspired our current DEI campus environment. Instead, we can use this unexpected opportunity to pick up where we left off and ensure that every program, every aspect of the curriculum, every student service is designed with the needs of our very diverse student body in mind. We can stop treating the experiences and needs of white students as the default or the neutral.

    What would our institutions look like if normative whiteness were no longer at the center and the need for many of the special DEI alternatives were made moot? Let’s find out.

    A decade of debate: Celebrating 10 years of the Chicago principles

    In 2014, American colleges faced an existential crisis — campuses erupted over controversial speakers as the heckler’s veto increasingly replaced debate. In response, the University of Chicago drafted a landmark statement reaffirming the school’s commitment to free speech.

    Since then, more than 110 colleges and universities have adopted the “Report of the Committee on Freedom of Expression,” commonly known as the Chicago Statement or the Chicago principles, transforming the landscape of higher education in the country.

    In a star-studded, all-day symposium last month, the University of Chicago celebrated the 10-year anniversary of the iconic Statement and its famous assertion, “It is not the proper role of the university to attempt to shield individuals from ideas and opinions they find unwelcome, disagreeable, or even deeply offensive.”

    The mood was celebratory, reflective, and at times foreboding as panelists shared insights into the drafting and implementation of the principles, debated the future of free speech in academia, and explored the impact of artificial intelligence on expression.

    In his opening remarks, university President Paul Alivisatos reflected on the “crisis” in higher education regarding academic freedom, and that it is nearly “impossible” to have a serious discussion about the topic without mentioning the Chicago Statement. While the causes of this crisis are varied, Alivisatos pointed to the principles as a tonic to cure the ills of higher education. Reflecting on the cultural moment in which the principles were drafted, he reminded the audience of a widely cited line from the statement:

    “Education should not be intended to make people comfortable, it is meant to make them think.”

    He concluded by inviting other universities to join UChicago in its “compelling vision” for the preservation of free expression.

    longtime leader in the fight for free speech, the university welcomed several members of the original drafting committee to discuss the legacy of the principles. The drafters expressed surprise by how quickly the principles spread to other campuses, but were proud of the impact they’ve had. The real focus of the committee, though, was to codify what Alivisatos described as the institution’s unique “culture built on the wellspring of free expression,” rather than something entirely new.

    The challenge to universities is much greater today than it was 10 years ago.

    Geoffrey Stone, the First Amendment scholar and chair of the committee, spoke of the “fundamental challenge” universities face in encouraging students and faculty to speak their minds. Kenneth Warren, professor of English, echoed this by speaking of faculty members “who are taking on the deep responsibility of exploring difficult questions.”

    The conversation was engaging and frank — all faculty members acknowledged challenges and remained open to the possibility that mistakes may be made along the way — sentiments true to the ethos of the principles themselves.

    Columbia University Provost Angela Olinto, another member of the original committee, highlighted the practical value of an institution adhering to a free speech statement and embracing institutional neutrality. She explained how these principles help administrators defend speech by giving them guidelines to reference in response to censorious mobs — a benefit that FIRE has long championed. She then explained that once an institution defends an individual’s right to speak freely, it is important that the speaker in turn seize the opportunity to do so.

    As the panel noted, FIRE has endorsed the Chicago Statement since the very beginning and has maintained the widely referenced list of adoptions nationwide. At a time when free speech and academic freedom face constant threats, we hope to see more institutions join the ever-growing list of those committed to fostering the free exchange of ideas.

    “The challenge to universities is much greater today than it was 10 years ago,” Stone told FIRE in an interview following the panel. “Put simply, speech that one finds offensive and even hurtful in public discourse must be protected, and those who disagree must be given reasonable opportunities to respond.”

    He added, “This can be challenging, but it is essential if we are to preserve the most fundamental values of higher education at this very challenging time.”
