    Migrant Higher Ed Program Still in Limbo After ED Lifts Freeze

    College leaders are breathing a tentative sigh of relief after the Trump administration promised Friday to release roughly $5 billion in withheld education funding, slated for a range of K–12 programs but also $716 million for adult education programs. Not included in Friday’s announcement, however, was $52 million allocated for migrant higher education programs.

    On June 30, the Department of Education paused nearly $7 billion in education funding expected on July 1, as part of a review by the Office of Management and Budget. Over the weeks of uncertainty that followed, community college leaders feared that, without the funds, they’d need to strip back adult education programming, like GED programs, and lay off personnel. Lawmakers on both sides of the aisle called for the funds’ release. A group of 10 Republican senators demanded an end to the freeze in a July 16 letter to OMB. Democratic governors from 18 states also wrote to Education Secretary Linda McMahon with the same plea.

    Rachel Gasseling, adult education director at Western Nebraska Community College, said that she was heartbroken when the Education Department paused the adult education funds. Her program serves the rural Nebraska panhandle and had a record 27 graduates this past academic year, an almost 69 percent increase over the year before. Adult ed programs served more than 9,300 students statewide last year, she said.

    “By all measures, we were going above and beyond to help our communities and help people build better lives,” Gasseling wrote to Inside Higher Ed. “Every day we waited to know whether we had to start looking for a new job or hold out one more day in hopes we can keep doing what we love.”

    Now she knows her work can continue. Her college was able to float the program until the funds returned. But for some programs across the country, the damage is already done, she said. They closed or reduced staff or services when the funds didn’t come through.

    “A great deal of people have been affected by this decision, and I hope that programs are able to rebuild or stay afloat for the sake of neighbors and communities,” she said.

    David Baime, senior vice president for government relations at the American Association of Community Colleges, said nationwide, state and campus leaders are “extremely relieved” by the news of the restored adult education funds. Now community college leaders hope these programs receive continued support in the 2026 fiscal year appropriations process. 

    “The loss of these funds would have been devastating to hundreds of community colleges, and some programs were already scaled back given the hiatus in support,” he wrote in an email to Inside Higher Ed. “Community colleges are deeply thankful that key legislators stood up for this essential function.”

    Heather Morgan, executive director of the Kansas Association of Community Colleges, said she’s glad to see the funds released but remains wary about the future of adult education programs under the Trump administration. Trump proposed axing these programs in his budget proposal for fiscal year 2026.

    “While this funding helps the programs continue, we will continue to watch the upcoming appropriations process as adult basic education is one of the areas proposed in the president’s budget for elimination,” Morgan wrote to Inside Higher Ed. “The uncertainty of funding makes keeping positions filled difficult as we work to serve adult learners.” The budget proposal would also eliminate funding for migrant education.

    The Education Department and the Office of Management and Budget did not respond to requests for comment.

    Migrant Programs In Flux

    Funds for other postsecondary programs still hang in the balance. Even as the Education Department released funding to states for migrant education at the K–12 level, money for two postsecondary migrant programs remains frozen: the High School Equivalency Program, a program that supports migrant farmworkers and their families in earning their GEDs, and the College Assistance for Migrants Program, which helps recruit and support those students through their first year of college.

    Greg Contreras, the director of the National HEP/CAMP Association, told Inside Higher Ed that the release of funds for the K–12 Migrant Education Program was “definitely encouraging.” But he said he has still received no word on if and when the review of HEP and CAMP may come to an end.

    Without the money to support HEP and CAMP, colleges and universities have been forced to shutter their programs and lay off employees who work with migrant students.

    “As each week rolls by, more programs are starting to drop off,” Contreras said. He received a layoff notice for his own position leading the CAMP initiative at Portland Community College in Oregon; originally, he was told his last day would be in August, but he is working with administrators to see if he might be able to stay through the start of PCC’s fall semester in September.

    Along with funding resources for migrant students, money for CAMP also goes toward scholarships and stipends. Michael Heim, the director of HEP and CAMP at Washington State University, said that his program’s incoming students are grappling with whether they will be able to enroll if the money doesn’t come through. Potentially losing out on scholarships they were promised will be a major factor in their decision-making, he said. But they’re also concerned about their academic success without access to the specialized resources CAMP typically offers, such as tutoring and mentorship.

    “The question they ask themselves is, ‘How do I find community, how do I know people will be in my corner to support me?’” he said. “I think it speaks to a mentality within our students, over all, that they know they want to go to college, but they want to be successful, because the values their families are instilling them are: They know education is important, and they don’t want to miss this opportunity to make their parents proud, make their siblings proud.”

    The National HEP/CAMP Association and its members aren’t backing down yet. The board recently traveled to Washington, D.C., where Contreras said they met with over 30 congressional staff members who they hope will pass along their messages about the importance and effectiveness of the programs.

    Even HEP and CAMP staff who have lost their jobs are staying involved in the effort to get their funding restored, he said, contacting their own congresspeople to ask them to push for the funds to be released.

    “We’re not giving up,” he said.

    Early this month, the U.S. Department of Education issued an ultimatum to K-12 public schools and state education agencies: Certify that you are not engaging in discrimination under the banner of diversity, equity and inclusion, or risk losing federal funding — including billions in support for low-income students.

    The backlash was immediate. Some states with Democratic governors refused to comply, arguing that the directive lacks legal basis, fails to clearly define what constitutes “illegal DEI practices,” and threatens vital equity-based initiatives in their schools.

    After lawsuits from the National Education Association teachers union and the American Civil Liberties Union, the Department of Education agreed to delay enforcement until after April 24.

    But states across the country, both liberal- and conservative-led, are worried about losing other aid: the pandemic-era money that in some cases they’ve already spent or committed to spending.

    The Department of Education has long played a critical role in distributing federal funds to states for K-12 education, including Title I grants to boost staffing in schools with high percentages of low-income students, and emergency relief like that provided during the COVID-19 pandemic.

    Conservative-led states — particularly Mississippi, South Dakota and Arkansas — rely the most heavily on these funds to sustain services in high-need districts.

    The 15 states with the highest percentage of their K-12 budget coming from federal funding in fiscal year 2022 — the latest year with data available from the National Center for Education Statistics — voted for Trump in the 2024 presidential election. Similarly, 10 of the 15 states receiving the highest amounts of Title I funding in fiscal year 2024 also voted for Trump.

    Mississippi and Kentucky have sent letters to the Department of Education expressing concern over halted pandemic aid.

    The clash over federal funding comes even as the future of the Department of Education is murky, given President Donald Trump’s pledge to dismantle the department.

    DEI-related cuts

    In letters to the Department of Education, state officials and superintendents in Illinois, New York and Wisconsin pushed back against the DEI directive.

    New York officials said they would not provide additional certification beyond what the state already has done, asserting that there “are no federal or State laws prohibiting the principles of DEI.” Illinois Superintendent Tony Sanders wrote that he was concerned that the Department of Education was changing the conditions of federal funding without a formal administrative process. Wisconsin Superintendent Jill Underly questioned the legality of the order.

    New York State Department of Education Counsel and Deputy Commissioner Daniel Morton-Bentley noted that the federal department’s current stance on DEI starkly contrasts with its position during Trump’s first term, when then-Education Secretary Betsy DeVos supported such efforts.

    Colorado and California also confirmed they would not comply with the Department of Education’s order.

    While some states with liberal leaders are gearing up for legal battles and possible revocation of funding, conservative-led states such as Florida have embraced the federal directive as part of a broader push to reshape public education.

    In Florida, anti-DEI laws have been in place dating back to 2023. In fact, many school districts and the state education department say they plan to follow the federal department’s directives, noting the similar state laws.

    Pandemic aid cancellations

    In March, the Department of Education abruptly rescinded previously approved extensions of pandemic-era aid, ending access to funds months ahead of the original March 2026 deadline.

    When the Massachusetts governor’s office voiced concern over that decision, the federal department’s reply on social media was blunt: “COVID is over.

    Sixteen mostly Democratic-led states and the District of Columbia filed a federal lawsuit against the Department of Education and Secretary Linda McMahon, challenging the abrupt rescission of previously approved extensions for spending COVID-19 education relief funds.

    But backlash against abrupt federal cuts to education has not been limited to blue states.

    Mississippi’s Department of Education warned the cuts would jeopardize more than $137 million in already obligated funds, slated for literacy initiatives, mental health services and infrastructure repairs. “The impact of this sudden reversal is detrimental to Mississippi students,” state Superintendent Lance Evans wrote in a letter to McMahon.

    The letter also outlines the state’s repeated — but unsuccessful — efforts to draw down millions in approved funds since February.

    Shanderia Minor, a spokesperson for the Mississippi education department, told Stateline the agency is awaiting next steps and direction about the funds and federal directives.

    In Kentucky, state Education Commissioner Robbie Fletcher told districts — which stand to lose tens of millions in pandemic aid — that abrupt federal changes leave them “in a difficult position,” with schools already having committed funds to teacher training and facility upgrades.

    According to Kentucky Department of Education spokesperson Jennifer Ginn, the state has about $18 million in unspent pandemic aid funds left to distribute to districts. And districts have about $38 million in unspent funds, for a total $56 million that could be lost.

    Lauren Farrow, a former Florida public school teacher, told Stateline that schools that receive Title I money are already underfunded — and the federal threat only widens the gap.

    “Florida is pouring billions into education — but where is it going? Because we’re not seeing it in schools, especially not in Title I schools,” said Farrow. “I taught five minutes away from a wealthier school, and we didn’t even have pencils. Teachers were buying shoes for students. Why is that still happening?”

    Effects in the classroom

    Tafshier Cosby, senior director of the Center for Organizing and Partnerships at the National Parents Union, a parents advocacy group, told Stateline that while most families don’t fully understand the various school funding systems, they feel the impact of cuts in the classroom.

    Cosby said parents are worried about the loss of support services for students with disabilities, Title I impacts, and how debates about DEI may deflect from more urgent needs like literacy and teacher support.

    “We’ve been clear: DEI isn’t the federal government’s role — it’s up to states,” she said. “But the confusion is real. And the impact could be devastating.”

    Today, as a consultant working with teachers across Florida’s Orange County Public Schools — one of the largest districts in the country — Farrow says many educators are fearful and confused about how to support their students under changing DEI laws.

    “Teachers are asking, ‘Does this mean I can’t seat a student with glasses at the front of the room anymore?’ There’s so much fear around what we’re allowed to do now.”

    “There’s no one giving teachers guidance or even basic acknowledgment. We’re just left wondering what we’re allowed to say or do — and that’s dangerous.”

    Students and Institutions in Limbo After Mass Layoffs at OCR

    A month after the Department of Education closed seven of its 12 regional civil rights offices and laid off nearly half the staff in the Office for Civil Rights, there’s still uncertainty about how the agency will perform its functions with such reduced numbers.

    OCR was founded to ensure equal access to education for all students and is responsible for investigating claims that schools and institutions of higher education failed to protect their students from discrimination. But under the current administration, the office has shifted gears to focus on President Donald Trump’s top priorities: removing trans women from women’s sports teams, protecting against alleged discrimination against white students, and protecting students against alleged antisemitism.

    Back in February, the office’s acting head, Craig Trainor, told employees to pause all investigations except for a handful that aligned with those priorities, according to ProPublica. Trainor quickly told investigators they could once again begin investigating disability-related complaints, which made up the largest share of the pending complaints, but not those related to race- or sex-based discrimination.

    Tracey Vitchers, the executive director of It’s On Us, a nonprofit advocacy organization focused on combating campus sexual violence, says this harks back to the first Trump administration: At the time, a large number of complaints were “quietly ignored” by OCR, leading to a massive backlog for former president Joe Biden’s administration to handle when he came into office in 2021.

    “That was the playbook during the first administration, and it was just that they just sat on shelves, essentially—digital shelves. Those cases were put on the digital shelf, ignored, not opened, not investigated,” she said.

    When Trump took office, more than 12,000 cases were open with OCR, including over 3,000 at institutions of higher education, according to a database of open OCR cases.

    Over half of all OCR cases were being handled by a regional office that is now closed, according to a report from Sen. Bernie Sanders, a Vermont Independent who is the ranking member on the Senate Health, Education, Labor and Pensions Committee. Following the layoffs, each investigator’s caseload—which was already at an all-time high of 42 cases—is expected to skyrocket to 86 cases as a result of the cuts, significantly reducing investigators’ ability to resolve each complaint, per the report.

    The data in the report reflects concerns from former OCR staffers who warned that the layoffs would make protecting students’ civil rights more difficult.

    Experts say that OCR complaints going unresolved can be a serious impediment to a student’s ability to learn.

    “At the postsecondary level, common complaints are refusals to accommodate,” said Paul Grossman, an attorney who worked at OCR for 41 years and is now executive counsel for the Association for Higher Education and Disability. “A student wants a particular kind of accommodation, and the school says, ‘No, that’s a fundamental alteration or an undue burden,’ and the student, as a result, may get dismissed because they don’t meet the academic standards, may get dismissed because they don’t meet conduct standards, whatever the case may be. Or the student may just be unhealthy—they may not be well enough to continue, because they don’t get the accommodation.”

    The public repository of open OCR cases, which used to be updated weekly, has not been updated since Jan. 14, just before Inauguration Day. But ProPublica reported in late February that only about 20 new cases have been opened since Trump took office, whereas about 250 cases were opened in the same period last year.

    That most likely comes down to OCR’s decisions about what to investigate. But Vitchers also noted that, since even before Trump’s second term began, she hasn’t been as eager to advise students to open a case with OCR in response to their institutions mishandling Title IX complaints. After the Biden administration finalized its Title IX regulations, which offered protections to transgender students and which organizations like It’s On Us said were much more sympathetic to victims of sexual violence than Trump’s previous regulations, in the summer of 2024, numerous states sued to block the regulations. The legal tussle made for a complicated environment for students seeking justice for sexual harassment or assault through Title IX, and the Biden rule was eventually vacated just over a week before Inauguration Day.

    “Very honestly, with the back-and-forth on Title IX, and particularly once we saw the Biden rule get challenged, we sort of, somewhat quietly, encouraged students to really pause and take a hard look at, what was the outcome that they were looking for? And help them assess, is the OCR complaint going to get you the outcome that you’re actually looking for here?” she said. “If it is, then we will support you in finding an attorney and filing a case. But with so many of the students that we work with, many of them made the decision to, essentially, protect their own peace.”

    ED did not respond to a request for comment.

    Mediation, Digital Accessibility and More

    On top of concerns about the backlog of complaints going unanswered, experts are also worried about other, lesser-known functions of OCR that likely are not currently happening.

    In some cases, complainants can opt for early mediation, a type of resolution that is more informal and generally quicker than an investigation. But it is unclear if such mediations are happening currently; Grossman said he has heard one example of a planned mediation being canceled, and ED did not respond to a question from Inside Higher Ed about the issue. Grossman also noted that OCR is responsible for continuing to monitor the aftermath of investigations that have already been resolved.

    Jamie Axelrod, director of disability resources at Northern Arizona University and a past president of AHEAD, pointed out that OCR is responsible for conducting digital compliance reviews, in-depth surveys of whether a school or university’s digital resources, such as its website and learning management systems, are accessible to students with disabilities. During the previous Trump administration, Axelrod said, ED stood up a specialized team to complete these reviews and provide technical assistance to institutions to help them make their digital resources more accessible. Now, that team has been reduced significantly, according to Axelrod.

    He also noted that OCR is supposed to be a tool schools and universities can turn to in order to answer any questions about how to appropriately accommodate their students.

    “The point of that is to avoid circumstances that wind up causing discrimination against students with disabilities, and so that’s a key role,” he said. “And it’s hard to really calculate how many instances of discrimination [that prevented from] happening in the first place. It’s hard to count what you prevented, but that is an important role, and I’m sure it leads to resolution of lots of complicated circumstances.”

    The impacts of the cuts are likely to go even deeper than the individual cases that have been displaced to new investigators and the specific programs that will likely fall by the wayside.

    “Like any postsecondary educational institution, there’s a lot of institutional memory that’s developed,” Grossman said. “You have to develop connections, relationships, understandings, insights, experience, and all these people who are going out the door, you’re just lighting a match to all that expertise and experience. And to me, that’s a really sad thing.”
