    Lane Community College Board Approves Budget Reduction

    The Lane Community College Board of Education voted to approve college leaders’ plans for a budget reduction on Jan. 7, despite fierce pushback from the faculty union. The latest controversy comes amid a dramatic year for the Oregon community college, marked by long, fractious board meetings and an ongoing battle between administrators and faculty over stalled labor negotiations and course cuts.

    College administrators argue the approved proposal—cutting spending by $8 million over the next three years—is a financial necessity. They say the college regularly falls short of a board requirement to maintain 10 percent of its balance in reserves. Administrators also conducted a new multiyear forecast that predicted expenses are going to grow.

    The college is expected to be “in a deficit every year … if we continue on the same trends that we have been in the last two or three years,” said Kara Flath, Lane’s vice president of finance and operations. The plan also proposes using some of the freed-up money for deferred maintenance and other projects.

    But faculty union leaders disagree with the administration’s view of the college’s financial present and future. Adrienne Mitchell, president of the faculty union, the Lane Community College Education Association, believes leadership’s projections are pessimistic and that a roughly 8 percent cut to the $104 million operating budget is excessive.

    “We don’t believe any of those cuts are necessary,” Mitchell said. “Currently, all of our funding sources—state funding, property taxes and student tuition revenue—are up.”

    The union came out with an independent report last week suggesting that the college is in a sound financial position and should invest more, not less, in faculty and the campus over all. But faculty and administrators fundamentally disagree on how much spending will rise and what tranches of money the college has at its disposal.

    The union’s perspective that the college can spend less “makes the numbers look better,” Flath said. “But as finance people, we have decades of finance experience” and such cost estimates are “not fiscally viable.”

    Mitchell also argued that Oregon Local Budget Law requires the board to follow a legal process that includes forming a committee of board and nonboard members, presenting the budget and hosting a public hearing, before formally adopting a budget. The union put out a legal memo on the matter in September.

    But administrators say their overarching plan isn’t the final budget—it doesn’t specify where exactly cuts will be made—so it doesn’t need to go through such a process yet. They said they plan to review programs, solicit community feedback and draw up a list of recommended cuts in the spring.

    Board members, initially skeptical of the plan’s lack of specificity, held multiple ad hoc budget committee meetings last week to discuss it ahead of the meeting on Wednesday, which lasted almost five hours.

    Board member Zach Mulholland said at the Wednesday meeting that he still sees “red flags and concerns with regards to unspecified cuts” but concluded, “at this moment in time, this appears to be a balanced proposal.” Mulholland and other board members on the ad hoc committee recommended the board move forward with the plan, as long as it includes annual updates and regular progress reports from administrators.

    “Now maybe as a college we can work together,” Flath said.

    Fraught Faculty Relations

    But the college is also mired in other controversies. The faculty union, which represents about 525 full- and part-time professors, has been without a contract since June as administrators and faculty clash over the details.

    Discussions have soured over disagreements about workloads, class-size limits, cost-of-living adjustments, the timing of layoff notices and the college’s efforts to strike some provisions, which Mitchell says amounts to a “net divestment” of over a million dollars in spending on faculty. The administration argued some of the issues in the proposed contract aren’t directly connected to faculty benefits, including proposals to add immigration status to the college’s nondiscrimination policy and ramp up campus safety measures.

    Grant Matthews, vice president of academic affairs, said significant progress has been made since the summer, but “really, we’re stuck on economics.”

    “We’re trying to really have a fiscally sustainable institution, and the proposals that we’re receiving at the table are not fiscally responsible,” he said. He estimated that the current contract proposal could cost the college up to $61 million.

    Professors aren’t pleased with how the process is going. In a December survey of 271 faculty members, 87 percent reported low morale, 90 percent said they didn’t trust the college’s president and 69 percent reported that they fear retaliation for expressing their views. The union has also raised concerns that faculty of color are leaving the college. On Wednesday, about 75 union members and supporters picketed outside ahead of the board meeting.

    Two more bargaining sessions are planned for this month, and mediation is scheduled after.

    Recent course cuts have also frayed relations between faculty and college leaders. Lane cut about 100 course sections for the winter and spring terms after introducing a new system that allows students to sign up in the fall for courses for the entire year.

    Administrators said this is a typical number of course cuts for the college, on par with past years, to optimize their academic offerings, and advisers are ensuring students still get the classes they need. But Mitchell described the move as a blow to part-time faculty, who lost classes that might have filled up later in the year. The union filed an unfair labor practice complaint with the Oregon Employment Relations Board, arguing the eliminated courses should have been a part of bargaining. Mitchell also worries the cuts are a roadblock for students who need to take certain courses, noting that a popular biology class—a prerequisite for many health professions courses—has a wait list of 168 students.

    Leadership Tensions

    The board, meanwhile, has had its own share of drama over the past year.

    The faculty union has accused administrators of encroaching on board responsibilities and criticized the board for failing to exercise its authority.

    “There’s been a lot of controversy surrounding the administration essentially taking over the role of the Board of Education,” Mitchell said.

    Meanwhile, in August, a third-party report concluded that Mulholland, formerly the board chair, and other board members discriminated against President Stephanie Bulger, a Black woman, on the basis of race and sex. The report described Mulholland and some other board members as displaying a dismissive or hostile attitude toward Bulger, cutting her off in conversations, and deferring questions to male staff. The report also found that Mulholland had intimidated a student. In September, the board censured the former board chair, who apologized, and the full board then came out with a joint apology.

    “We are deeply sorry for the negative impact our behavior has had on you and the college community at large,” said Austin Fölnagy, the current board chair, who was also accused of adopting a dismissive tone toward the president. “President Bulger, please accept the board’s apology for treating you badly.”

    Mitchell said the union is “very concerned about any type of discrimination, and we think it’s really important for everyone on the campus to feel safe.”

    The college’s accreditor, the Northwest Commission on Colleges and Universities, also deemed the college “substantially in compliance” with accreditation standards but “in need of improvement” in a notice last March. The accreditor recommended the college evaluate its internal communication and ensure decision-making processes are “inclusive of all constituents,” among other suggestions.

    Michigan State University has cut 99 positions as part of a comprehensive cost-reduction strategy aimed at addressing mounting financial pressures, President Kevin Guskiewicz announced in a recent letter to campus stakeholders.

    The elimination of positions—spanning executive roles, support staff, faculty, and academic staff—represents the first phase of an $85 million budget reduction plan the institution unveiled in May. The cuts do not include non-renewed fixed-term appointments.

    The predominantly white institution in East Lansing is targeting a 6% spending reduction this fiscal year, totaling $50 million, with plans to cut an additional $35 million—or 3%—in the following fiscal year.

    Departments were directed to minimize personnel reductions during the initial year of cuts. Nearly two-thirds of this year’s $50 million reduction came from non-personnel expenses, including supplies and services, though layoffs proved unavoidable.

    Beyond internal budget constraints, federal funding cuts eliminated an additional 83 positions at the university. In late July, 94 MSU Extension staff members lost their positions following the discontinuation of the Supplemental Nutrition Assistance Program-Education (SNAP-Ed), which provided nutrition and physical activity programming to low-income families.

    Combined, the reductions have impacted 1.3% of MSU’s workforce since March 1.

    Guskiewicz attributed the budget crisis to multiple factors: double-digit increases in employee healthcare costs, federal funding reductions, and accumulated general fund deficits from previous years.

    The financial challenges persist despite MSU reporting its second-largest fall enrollment of 51,838 students and receiving a modest 2.1% increase in state appropriations, totaling approximately $333.8 million.

    “We have taken the first difficult and necessary steps to assure the university’s financial sustainability,” Guskiewicz wrote, thanking faculty and staff for their commitment to the institution’s mission.

    The university will launch its next budgeting cycle shortly, with request letters scheduled for early November and submissions due Jan. 23. Guskiewicz pledged to share additional information as the fiscal year concludes.

    MSU is providing outplacement services to eligible individuals affected by the cuts. The president acknowledged that some reductions continue to unfold through union and Human Resources processes.

    “I appreciate the compassion our teams are showing one another during this period, as well as your patience in understanding that we are trying to share information transparently and in a timely manner,” he stated.

    The university operates on a nearly $3.7 billion budget, with $1.7 billion allocated to the general fund.

    It is high time higher education adopted a harm reduction approach to drug use among students

    While Gen Z is showing less interest in the normalised alcohol and drug excess that dogged their preceding generations, England and Wales’ most recent stats confirmed that 16.5 per cent of people aged between 16 to 24-years-old took an illegal drug in the last year.

    Additionally, a 2024 report by Universities UK found that 18 per cent of students have used a drug in the past with 12 per cent imbibing across the previous 12 months. With a UK student population of 2.9m, this suggests the drug-savvy portion is around 348,000 to 522,000 people.

    It’s prudent, therefore, for anyone involved within student safety provision to know that the UK is currently mired in a drug death crisis – a record 5,448 fatalities were recorded in England and Wales in the most recent statistics, while Scotland had 1,172, the highest rate of drug deaths in Europe.

    In an attempt to ameliorate some of this risk, seven UK universities recently took delivery of nitazene strips to distribute among students, facilitated by the charity Students Organising for Sustainability (SOS-UK). These instant testing kits – not dissimilar to a Covid-19 lateral flow test in appearance – examine pills or powders for nitazenes: a class of often deadly synthetic opioids linked with 458 UK deaths between July 2023 and December 2024.

    While these fatalities will have most likely been amongst older, habitual users of heroin or fake prescription medicines, these strips form part of a suite of innovative solutions aimed at helping students stay safe(r) if they do choose to use drugs.

    The 2024 Universities UK report suggested drug checking and education as an option in reducing drug-related harm, and recommended a harm reduction approach, adding: “A harm reduction approach does not involve condoning or seeking to normalise the use of drugs. Instead, it aims to minimise the harms which may occur if students take drugs.”

    With that in mind, let’s consider a world where harm reduction – instead of zero tolerance – is the de facto policy and how drug checking or drug testing plays a part in that.

    Drug checking and drug testing

    Drug checking and drug testing are terms that often get used interchangeably but have different meanings. Someone using a drug checking service can get expert lab-level substance analysis, for contents and potency, then a confidential consultation on these results during which they receive harm reduction advice. In the UK, this service is offered by The Loop, a non-profit NGO that piloted drug checking at festivals in 2016 and now have a monthly city centre service in Bristol.

    Drug testing can take different forms. First, there is the analysis of a biological sample to detect whether a person has taken drugs, typically done in a workplace or medical setting. There are also UK-based laboratories offering substance analysis, that then gets relaid to the public in different ways.

    WEDINOS is an anonymous service, run by Public Health Wales since 2013, where users send a small sample of their substance alongside a downloadable form. After testing, WEDINOS posts the results on their website (in regards to content but not potency) normally within a few weeks.

    MANDRAKE is a laboratory operating out of Manchester Metropolitan University. It works in conjunction with key local stakeholders to test found or seized substances in the area. It is often first with news regarding adulterated batches of drugs or dangerously high-strength substances on the market.

    Domestic testing is also possible with reagents tests. These are legally acquired chemical compounds that change colour when exposed to specific drugs and can be used at home. They can provide valuable information as to the composition of a pill or powder but do not provide information on potency. The seven UK universities that took delivery of nitazene strips were already offering reagents kits to students as part of their harm reduction rationale.

    Although the Misuse of Drugs Act 1971 specifies that certain activities must not be allowed to take place within a university setting, the Universities UK report argued that universities have some discretion on how to manage this requirement. Specifically, it stated: “The law does not require universities to adopt a zero tolerance approach to student drug use.”

    How to dispense testing apparatus

    The mechanisms differ slightly between SUs but have broad similarities. We spoke with Newcastle and Leeds (NUSU and LUU) who both offer Reagent Tests UK reagent testing kits, fentanyl strips and now nitazene strips. Reagent’s UK kits do not test for either of these two synthetic opioids. They vary in strength compared to heroin – and there are multiple analogues of nitazene that vary in potency – but an established ballpark figure is at least 50 times as strong.

    All kits and tests are free. Newcastle’s are available from the Welfare and Support centre, in an area where students would have to take part in an informal chat with a member of staff to procure a kit. “We won’t ask for personal details. However, we do monitor this and will check in with a welfare chat if we think this would be helpful,” says Kay Hattam, Wellbeing and Safeguarding Specialist at NUSU. At Leeds, they’re available from the Advice Office and no meeting is required to collect a kit.

    Harm reduction material is offered alongside the kits. “We have developed messaging to accompany kits which is clear on the limitations of drug testing, and that testing does not make drugs safe to use,” says Leeds University Union.

    Before the donation, kits were both paid for by the respective unions and neither formally collected data on the results. Both SUs both make clear that offering these kits is not an encouragement of drug use. Kay Hattam draws an analogy: “If someone was eating fast food every day and I mentioned ways to reduce the risks associated with this, would they feel encouraged to eat more? I would think not. But it might make them think more about the risks.”

    You’ll only encourage them

    In 2022, in a report for HEPI, Arda Ozcubukcu and Graham Towl argued, “Drug use matters may be much more helpfully integrated into mental health and wellbeing strategies, rather than being viewed as a predominantly criminal justice issue.”

    The evidence backs up the view that a harm reduction approach does not encourage drug use. A 2021 report authored by The Loop’s co-founder Fiona Measham, Professor in Criminology at the University of Liverpool, found that over half of The Loop’s users disposed of a substance that tested differently to their intended purchase, reducing the risk of poisoning. Additionally, three months after checking their drugs at a festival, around 30 per cent of users reported being more careful about polydrug use (mixing substances). One in five users were taking smaller doses of drugs overall. Not only does this demonstrate that better knowledge reduces risk of poisoning in the short-term, but it also has enduring positive impacts on drug-using behaviours.

    SOS-UK has developed the Drug and Alcohol Impact scheme with 16 universities and students’ unions participating. This programme supports institutions in implementing the Universities UK guidance by using a variety of approaches to educate and support students in a non-stigmatising manner.

    Alongside them is SafeCourse, a charity founded by Hilton Mervis after his son Daniel, an Oxford University student, died from an overdose in 2019. The charity – which counts the High Court judge Sir Robin Knowles and John de Pury, who led the development of the 2024 sector harm reduction framework, among its trustees – is working to encourage universities to move away from zero tolerance.This is through various means, including commissioning legal advice to provide greater clarity on universities’ liability if they are not adopting best practice, and checking in one year on from the Universities UK report, to ascertain how they’re adapting to the new era of harm reduction.

    SafeCourse takes the view that universities must not allow themselves to be caught up prosecuting a failed war on drugs when their focus should be student safety, wellbeing and success. A harm reduction approach is the best way of achieving those ends.

    Education attorneys are set to launch a new organization by fall 2025 that would defend students’ civil rights in court and also track and report civil rights data. The effort, according to its founding nonprofit, aims to fill the gap left by the Trump administration’s dismantling of the U.S. Department of Education and its civil rights enforcement arm. 

    The Public Education Defense Fund will be launched by the National Center for Youth Law, which advocates for educational equity among other youth-related issues. It will contract with former Office for Civil Rights attorneys. 

    “At a time when civil rights protections for students are under unprecedented attack, preserving those rights is not negotiable — it’s vital,” said Johnathan Smith, chief of staff and general counsel at NCYL. “We can’t stand by while the federal government abandons its responsibility to uphold the basic rights of children and young people in this country.”

    As part of the administration’s efforts to “end bureaucratic bloat” and send educational control to the states, U.S. Secretary of Education Linda McMahon laid off half of the Education Department’s staff as part of what she called the agency’s “final mission.” The move was followed by an executive order from President Donald Trump calling for the department to be shut down to “the maximum extent appropriate and permitted by law.”

    The Education Department’s Office for Civil Rights took a major blow, with the department shuttering seven of the 12 regional offices that were in charge of more than half of the nation’s open civil rights cases. Over 200 OCR employees were laid off as part of the reduction in force.

    Under the Biden administration, those employees carried a load of more than 40 cases per person. Attorneys fired as part of the reduction in force were in charge of investigating civil rights complaints related to discrimination and harassment in schools, as well as overseeing resolution agreements with school districts. These agreements guide the school systems involved in making policy changes to improve educational access, especially for historically marginalized students.

    Prior to the announcement of the Public Education Defense Fund, NCYL filed a lawsuit against the Education Department in March to challenge the changes at the OCR. The lawsuit said the civil rights enforcement arm “stopped investigating complaints from the public based on race or sex discrimination, it cherry-picked and, on its own initiative, began targeted investigations into purported discrimination against white and cisgender students.”
