    The details behind the first national school voucher program

    After decades of trying, conservatives this year succeeded in creating the first national school voucher program.

    The Republican megabill that President Donald Trump signed into law in July will establish new tax credit scholarships for families to use at private schools, including religious ones — a long-held goal of school privatization advocates who argue parents should get taxpayer support if they want to opt out of their neighborhood school.

    Under the “big, beautiful bill,” donors can receive dollar-for-dollar tax credits of up to $1,700 for contributions to scholarship-granting nonprofits. Those groups then distribute the money to families seeking help paying for private school, tutoring and other educational expenses. 

    The program, while significant, is less expansive than in earlier drafts of the legislation. Previous versions gave donors larger tax credits — a match up to $5,000 or 10 percent of their income, whichever is greater — and mandated that all states participate rather than allowing them to opt in.

    When does it start?

    Jan. 1, 2027. Families have until then to research where they might want to spend a scholarship — and if the school in mind even plans to accept one. Taxpayers who want to contribute to support the scholarships can do so beginning in late 2026.  

    How will the scholarships work?

    The law opens the door to churches, universities, education nonprofits, rotary clubs and potentially even public schools (more on that below) to accept and distribute donations for the program. These “scholarship-granting organizations,” or SGOs, can keep up to 10 percent of the donations for administrative costs.

    In some states with existing scholarship programs, families apply with a third-party contractor that works with eligible schools and selects students for awards. Other states allow religious groups and other nonprofits to create and manage their own scholarship funds. The federal bill gives states wide flexibility to make those sorts of decisions about how the program is administered, experts say.

    Who’s eligible for the scholarships?

    To qualify, students need to check these boxes: They must be eligible to attend a public school, their state must opt in to the program, and their families must earn no more than three times the area median income — a threshold that would include households with incomes nearing $500,000 in some parts of the United States.

    Students who already attend private school qualify, since they are eligible for public school, even if they don’t attend one. The scholarships also may cover home-schoolers. (Keep reading for more on that.)

    How much money will families receive? 

    While the bill set a $1,700 cap on how much individual donors can contribute through their taxes, it’s unclear whether it limits how much an individual student could collect in scholarships.

    In theory, a student could apply for several scholarships. An SGO might also offer a scholarship that reimburses a family for all costs associated with attending their preferred school. In states that already offer similar school choice programs, a student might be able to collect scholarships from both the new program and the existing state program. Still, the average cost of private school tuition is roughly $13,000, so even students who combine several scholarships may not receive enough to cover the full cost of attending.

    The Treasury Department is expected to issue regulations on the program, and we may not know these kinds of details until it does.

    What can the scholarship money be used for?

    Quite a lot. The legislation suggests that families could use the money not only to help pay for private school tuition, but also for room and board, services for students with disabilities, transportation, tutoring, and school supplies like books, computers and uniforms. 

    The rules may depend on the individual state and its definition of an “eligible school.” In some states, home schooling might qualify students for the scholarships, but in other states it might not, said Robert Enlow, president of EdChoice, a pro-school choice group.  

    It’s also possible that public schools could charge scholarship students — as some do with home-schoolers — for services like tutoring, special education or advanced courses. 

    So students can use the money at public schools? How would that work? 

    Yes, potentially. In some states, schools already charge activity or participation fees for non-enrolled students who want to join clubs and sports. Marguerite Roza, director of the Edunomics Lab at Georgetown University, said some states may write their own rules that allow schools to extend the menu of services they could charge for.

    Meanwhile, most school districts — roughly 4 in 5 — already partner with foundations that raise money to help students with transportation, school supplies and basic needs. Both Enlow and Roza said they expected nonprofits and districts to partner on finding ways to tap the federal scholarship dollars as well.

    “Imagine you could have a public school foundation going out and helping with transportation and books and computers and tutors and all sorts of stuff, right?” Enlow said. “The potential is huge.”

    Will all private schools accept the scholarships? 

    No, private schools are not required to accept the scholarships, and many states that offer school choice don’t require private schools to participate. Private schools generally can accept or reject a student for any reason, whether they have a scholarship or not.

    In Arizona, for example, the tax credit program provided scholarships to students at 348 schools last year. More than 400 private schools operated in the state as of 2022.

    Which states will participate?

    Roughly 21 states — including Arizona, Georgia and Montana — offer their own tax credit scholarships, according to the group EdChoice, so it’s expected they would opt into the federal program. Conservative lawmakers in North Carolina already introduced a bill to allow families there to take part in the federal scholarships. 

    If public schools can benefit too, even Democratic governors may consider joining the program, said Roza.

    “Ultimately if the state can open this to summer camp and tutoring, obviously there would be a lot of pressure to unlock so much money with this,” she said.

    How much will the scholarships cost the government?

    It depends on how many taxpayers claim the credit. 

    While an earlier version of the bill would have capped the tax credits at $10 billion a year, the final legislation contains no such limit — so the exact amount in lost revenue won’t be known until much later. That said, an analysis by the nonpartisan Joint Committee on Taxation found that the legislation would cost the Treasury up to $4 billion per year.

    Others think the cost will be higher. The Institute on Taxation and Economic Policy, a left-leaning research group, placed its projection closer to $51 billion, while Roza estimated the cost at $28 billion per year. Still, she hesitated to count that as a direct loss to K-12 funding. “It’s new money in the sense that it doesn’t go into or out of the federal pie,” Roza said.

    What’s been the reaction to the plan? 

    Critics, including teachers unions and many education experts, have been quick to raise alarms about the voucher program, arguing that it’s a handout for wealthy families and will harm public schools by reducing funding for them.

    “It’s the centerpiece of the Great American Heist — a privatization scheme wrapped in tax policy,” Denise Forte, president of the left-leaning nonprofit EdTrust, said at a hearing before the Senate Democratic Caucus in July. 

    Advocates for the separation of church and state worry about the program channeling money from government coffers to religious schools, while disability advocates note that private schools are not required to serve students with disabilities.

    Some supporters of school vouchers, meanwhile, wish the legislation had gone further.

    “This is a very positive program for taxpayers in America. You can help families get better education and claim a tax credit for it,” said EdChoice’s Enlow. “It’s going to benefit middle- and low-income families.” But he added, “It’s not as generous as we would like, which is universal.”

    Others are focused now on encouraging states to participate in the program. “The fight doesn’t end with the passing of the bill,” said Sydney Altfield, national director of Teach Coalition, which advocates for Jewish schools to get access to government funding. “States must opt into the program.”

    A recent report from the University of Virginia—Good Fathers, Flourishing Kids — confirms what many of us know instinctively but rarely see, or avoid altogether, in education debates: The presence and engagement of a child’s father has a powerful effect on their academic and emotional well-being. It’s the kind of data that should stop us in our tracks — and redirect our attention away from educational fads and toward the foundational structures that shape student success long before a child ever sets foot in a classroom.

    The research — led by my AEI colleague Brad Wilcox and co-authored by a diverse team that includes another AEI colleague, Ian Rowe — finds that children in Virginia with actively involved fathers are more likely to earn good grades, less likely to have behavior problems in school, and dramatically less likely to suffer from depression. Specifically, children with disengaged fathers are 68% less likely to get mostly good grades and nearly four times more likely to be diagnosed with depression. These are not trivial effects. They are seismic.

    Most striking is the report’s finding that there is no meaningful difference in school grades among demographically diverse children raised in intact families. Black and white students living with their fathers get mostly As at roughly equal rates — more than 85% — and are equally unlikely to experience school behavior problems. The achievement gap, in other words, appears to be less about race and more about the structure and stability of the family.

    This may be a surprising finding to some, but not to William Jeynes, a professor of education at California State University, Long Beach, whose meta-analyses have previously demonstrated the outsized academic impact of family structure and religious faith. (The new UVA report does not study the role of church-going). 

    As I wrote in How the Other Half Learns, Jeynes’ work highlights how two-parent households and religious engagement produce measurable benefits in educational achievement. “When two parents are present, this maximizes the frequency and quality of parental involvement. There are many dedicated single parents,” Jeynes has noted. However, the reality is that when one parent must take on the roles and functions of two, it is simply more difficult than when two parents are present.” Jeynes’ most stunning finding, and his most consistent, is that if a Black or Hispanic student is raised in a religious home with two biological parents the achievement gap totally disappears—even when adjusting for socioeconomic status.

    My colleague Ian Rowe has been a tireless advocate for recognizing and responding to these patterns. He has long argued that NAEP, the Nation’s Report Card, should disaggregate student achievement data by family composition, not just by race and income. That simple step would yield a more honest accounting of the challenges schools are facing — and help avoid both unfair blame and unearned credit.

    Yet this conversation remains a third rail in education. Many teachers and administrators are understandably wary of saying too much about family structure for fear of stigmatizing children from single-parent households, particularly in settings where single-parent households are dominant. Rowe has also faced resistance to his efforts to valorize the “Success Sequence,” the empirical finding that graduating high school, getting a full-time job and marrying before having children dramatically increases one’s odds of avoiding poverty. But being cautious is not the same as being silent, and it’s not compassionate to pretend these dynamics don’t matter when the data so clearly shows that they do.

    None of this absolves educators of their duty to reach and teach every child. But it does suggest we should be clear-eyed in how we interpret data and set expectations. Teachers, particularly those in low-income communities, often shoulder the full weight of student outcomes while lacking the ability to influence some of the most powerful predictors of those outcomes. That’s frustrating — and understandably so.

    Citing compelling evidence on fatherhood and family formation is not a call for resignation or excuse-making. It’s a call for awareness and intelligent action. While schools can’t influence or re-engineer family structure, teachers can respond in ways that affirm the role of fathers and strengthen the school-home connection. They can make fathers feel welcome and expected in school life — not merely tolerated. They can design family engagement activities that include dads as co-participants, not afterthoughts. They can build classroom cultures that offer structure and mentoring, especially to students who may lack it at home. 

    And maybe — just maybe — the field can overcome its reluctance to share with students what research so clearly shows will benefit them and the children they will have in the future. Rowe takes pains to note his initiative to teach the Success Sequence is intended to help students make decisions about the families they will form, not the ones they’re from. “It’s not about telling them what to do,” he says, “it’s about giving them the data and letting them decide for themselves.”

    This leads to a final point, and for some an uncomfortable one: If we truly care about student outcomes, perhaps we should be willing to support the institutions that reliably foster them. And that includes religious schools.

    Religious schools — particularly those rooted in faith traditions that emphasize marriage, family life and moral formation — often create environments where the presence of fathers and the reinforcement of shared values are not incidental but central. A recent analysis by Patrick J. Wolf of the University of Arkansas, published in the Journal of Catholic Education, found that adults who attended religious schools are significantly more likely to marry, stay married, and avoid nonmarital births compared to public‑school peers. The effects are most pronounced among individuals from lower‑income backgrounds.

    In states with Education Savings Accounts (ESAs) and other school choice mechanisms, we have an opportunity — perhaps an obligation — to expand access to these institutions. That’s not merely a question of parental rights or religious liberty. It’s a matter of public interest. If these schools produce better education and social outcomes by encouraging family formation and reinforcing the value of fatherhood, the public benefits — even if instruction is delivered in a faith-based context. Said simply: The goal of educational policy and practice is not to save the system. It’s to help students flourish.

    So yes, let’s fund fatherhood initiatives. Let’s run PSAs about the importance of dads. But let’s also get serious about expanding access to the kinds of schools — whether secular or religious in nature — that support the kind of family culture where children are most likely to thrive. Because if we follow the evidence where it leads, we must conclude that the biggest intervention in education is not another literacy coach or SEL curriculum. It’s dad.

    New Jersey has the lowest rates of inclusion for students in special education in the country

    New Jersey students with disabilities are the least likely in the nation to spend their days surrounded by peers without disabilities. 

    One underlying reason: a sprawling network of separate schools that allows districts to outsource educating them.

    New Jersey has more than a hundred private schools, plus eight county-run districts specifically for students with disabilities. 

    Districts spend hundreds of millions of dollars placing students in private schools rather than investing in their own staffing and programs — placements that cost New Jersey taxpayers $784 million in 2024, not including transportation. That’s up from about $725 million the year before. This can create a self-perpetuating cycle that increases reliance on separate schools and, experts say, may violate students’ federal right to spend as much time as possible learning alongside students without disabilities.

    In many cases, parents say school administrators are too quick to send children out of district and pressure families to agree to those settings. Other times, parents choose to send their child to a separate school, sometimes feeling that they have no choice after repeatedly failing to get their kids the help they need in their local school.

    “Whatever it is that their kids need within the district, they’re not getting,” said special education parent and advocate Amanda Villamar, who works with families throughout New Jersey. “The question becomes: Why are these services in private schools and not necessarily integrated into our public school system?”

    In all, about 30,000 students with disabilities in New Jersey — or 13 percent— attend separate private or public schools, according to The Hechinger Report’s analysis of federal data. That’s the highest percentage in the country. Nationwide, 4 percent attend separate schools. 

    New Jersey’s history of failing to include children with disabilities in public school classrooms dates back to the 1910s. That’s when the state began promoting separate schools for students with disabilities as a more humane alternative to barring them from schools altogether. 

    Nationwide, only 1 in 5 students with disabilities were enrolled in the public school system in the 1970s, when Congress passed the Individuals with Disabilities in Education Act or IDEA. The law enshrines integration by saying students with disabilities have a right to learn alongside students without disabilities to the “maximum extent” possible and that they should be placed in the “least restrictive environment.” 

    Across the nation, parents and children fought state laws excluding students with disabilities from public schools — with fights in Washington D.C. and Pennsylvania fueling the passage of IDEA. It wasn’t until 1992 that New Jersey repealed its statutes allowing public schools to exclude “untrainable” children with disabilities. By then, separate schools were an integral part of the state’s highly decentralized education system, which today comprises roughly 600 districts. 

    New Jersey Department of Education officials said the state is committed to ensuring students with disabilities are in the most appropriate school setting based on individual needs, and that includes out-of-district programs. 

    “New Jersey is uniquely positioned in this regard, with a longstanding infrastructure of out-of-district options and many small local public school districts,” department spokesman Michael Yaple said in an email. “These and other factors have contributed to the state’s historical reliance on a wide array of specialized programs designed to offer diverse, individualized educational options for students with disabilities.”

    The rate at which New Jersey school districts place students in separate schools has declined over the past two decades. In the same period, however, more parents chose to send their children to private schools, sometimes because they felt they had no other viable options.

    Some parents say there are significant trade-offs when their child leaves their district school.

    Ellen Woodcock’s son, a fifth grader, attends a county-run school for students with disabilities where she says teachers understand his autism much better than they did in her home district.* Despite her son’s fascination with geography, however, teachers spend little time on science or social studies. The school has no library, and the day ends an hour earlier than his district elementary school. School staff focus on teaching social skills, but he’s lost the chance to model the behavior of peers without disabilities. 

    “I feel like he’s not being challenged, like he’s kind of pigeonholed,” Woodcock said. “We just felt like we didn’t have a choice.”

    Her son spent kindergarten through second grade learning in general education classrooms at his local neighborhood school in Haddonfield, New Jersey, and she was happy with the social and academic progress he was making. In third grade, however, things changed. The school shifted him into a separate classroom for significant parts of the day. Woodcock said school staff seemed unable, or unwilling, to address how his autism affected his learning and provide the right support to account for it. She felt he was unwanted.

    In the middle of fourth grade, she said she reluctantly transferred him to a specialized school where he spent his day with other students with autism.

    “It was almost out of desperation,” Woodcock said. “It was like, let’s get him out of the school district, because we feel like they can’t support him. It was a fight all the time to get him what he needed.”

    Haddonfield district officials said privacy laws prevent them from commenting on individual students but noted that the percentage of students with disabilities who spend almost all of their time in general education classrooms is significantly higher than the state’s average. About 69 percent of Haddonfield students with disabilities spend at least 80 percent of the school day in general education classrooms, compared with 45 percent statewide, according to state Education Department data

    “We are proud of our inclusive practices and the strong sense of belonging we strive to create for all students,” district officials said in a statement. “The least restrictive environment can look different for each student.”

    In Haddonfield, 19 percent of parents with students with disabilities choose to enroll their children in private schools, compared with 7 percent statewide.

    Woodcock decided to move her son back to the district next year, where he’ll start sixth grade at the local middle school. She understands that her son may need to be pulled out of class to learn a subject like math in a special education resource room — but she believes he can, and should, learn in general education classrooms as well.

    Under IDEA, students with disabilities should be placed in separate schools or classes only if their disability makes it too difficult for them to learn in a regular classroom, even with extra help and support. A team made up of a child’s parents, teachers, school district officials and, when appropriate, the child, decide on a placement together and must review it each year. 

    The federal Department of Education says those teams have to make this decision based on an individual child’s needs — not solely because of the kind of disability, how significant the child’s needs are or whether the school has the money or the staff. In New Jersey, however, some parents say schools too often determine placement on a child’s diagnosis alone.

    Observers, including special education advocates and attorneys, say school districts and leaders of separate schools tend to argue it would be too difficult for all of New Jersey’s hundreds of public school districts to provide services for all types of disabilities. That’s fueled a reliance on private and county-run separate schools, many of which have classrooms or programs focused on a specific disability, such as autism or dyslexia, with specially trained teachers.  

    Districts sometimes launch specific special education programs — applied behavioral analysis classrooms for students with autism, for example — only to abandon them after challenges paying for them or finding qualified staff, said Paul Barger, a special education lawyer in Irvington, New Jersey.

    “Instead of continuing to develop their own programs in the districts, they went ahead and just said they’re placing out into state-approved private school programs,” Barger said.

    Returning some students with disabilities to in-district schools would require more money. Lawmakers in New Jersey are debating the governor’s proposal to boost funding for special education services in public schools by $400 million for the next school year. Advocates say that’s an opportunity to build stronger special education systems in public schools. The governor also proposed flat funding of $420 million for private school tuition payments for students with disabilities.

    Some parents, unhappy with the services they see in public districts, prefer private schools: A growing number pay for their children to attend. That’s despite the fact that those parents who choose private schools lose federal protections, including the rights to raise formal complaints. 

    ASAH, the group representing New Jersey private schools for students with disabilities, which enroll more than 10,000 students, points out the lack of special education services in public districts. It tells parents that poorly trained paraprofessionals in public schools can be stigmatizing, and placing students in self-contained classrooms doesn’t make students feel valued or included. The group, formerly known as the Association of Schools and Agencies for the Handicapped, argues private schools may not be more costly to the state than public schools once pensions are factored in.

    Students with disabilities have the right to options like private schools, the association’s executive director John Mulholland said in an interview. 

    “It really is an individualized determination, and merely just being a part of your home district isn’t always a least restrictive environment,” he said. 

    Unlike for public schools, the federal government doesn’t collect data from private schools about how often their students interact with peers without disabilities. According to the association’s recent study of 5,300 students served by ASAH schools, 262 students planned to leave their private schools in the 2022-23 school year to return to their home district. That report suggests such a move was less likely for children with autism and multiple disabilities.

    Mulholland said private schools may offer some interaction with students without disabilities through community service or sporting events. His association’s analyses have found that students who start at a private school earlier are more likely to return to their public school district. 

    “If students come to us younger, they can get the intensive support they need or return to their school districts — many of our members pride themselves on that turnaround,” Mulholland said.

    Nicole Lannutti, of Washington Township in Gloucester County, said her daughter Sophia, who is non-verbal and has multiple disabilities, attended a private preschool for one year at a cost to the district of roughly $90,000. (New Jersey requires school districts to provide preschool for students with disabilities.) 

    Lannutti pushed to get Sophia into the public school system for a second year of preschool and then elementary school, where she said her daughter thrived in a school that prioritized inclusion. But that changed in middle school, where her mom says she’s had to push to have her daughter included even in lunch, recess and extracurricular activities. Washington Township school district did not respond to requests for comment. 

    Lannutti said her local public school is still the most appropriate setting for her child, who will enter seventh grade in the fall and has made friends by participating in the school play. The school agrees, and said as much in her education plan. Lannutti said private schools play an important role, but public schools should work harder to serve more students and fulfill their civil right to an education. “When it comes to my kid, it’s not that she should go because this district can’t handle it,” Lannutti said. “They should learn how to do it.”

    Supreme Court takes education cases that could challenge the separation of church and state

    The Supreme Court over the next two weeks will hear two cases that have the potential to erode the separation of church and state and create a seismic shift in public education.

    Mahmoud v. Taylor, which goes before the court on April 22, pits Muslim, Roman Catholic and Ukrainian Orthodox families, as well as those of other faiths, against the Montgomery County school system in Maryland. The parents argue that the school system violated their First Amendment right of free exercise of religion by refusing to let them opt their children out of lessons using LGBTQ+ books. The content of the books, the parents say, goes against their religious beliefs.

    Oklahoma Statewide Charter School Board v. Drummond, which will be argued on April 30, addresses whether the St. Isidore of Seville Virtual Charter School should be allowed to exist as a public charter school in Oklahoma. The Archdiocese of Oklahoma City and the Diocese of Tulsa had won approval for the charter school from the state charter board despite acknowledging that St. Isidore would participate “in the evangelizing mission of the Church.”

    The state’s attorney general, Gentner Drummond, later overruled the approval, saying the school could not be a charter because charter schools must be public and nonsectarian. The petitioners sued and ultimately appealed to the Supreme Court, claiming Drummond violated the First Amendment’s free exercise clause by prohibiting a religious entity from participating in a public program.

    Teachers unions, parents groups and organizations advocating for the separation of church and state have said that rulings in favor of the plaintiffs could open the door for all types of religious programs to become part of public schooling and give parents veto rights on what is taught. In the most extreme scenario, they say, the rulings could lead to the dismantling of public education and essentially allow public schools to be Sunday schools.

    At issue in both cases is the question of whether the First Amendment rights of parents and religious institutions to the free exercise of religion can supersede the other part of the amendment, the establishment clause, which calls for the separation of church and state.

    “I think a chill wind is blowing, and public education as we know it is in extreme jeopardy of becoming religious education and ceasing to exist,” said Rachel Laser, president of Americans United for Separation of Church and State, an advocacy organization that has filed an amicus brief in the St. Isidore case. “The whole idea is to have churches take control of education for American children. It’s about money and power.”

    For some conservative lawmakers, evangelical Christian groups and law firms lobbying for more religiosity in the public square, decisions in the petitioners’ favor would mean religious parents get what they have long been owed — the option of sending their children to publicly funded religious schools and the right to opt out of instruction that clashes with their religious beliefs.

    “If we win this case, it opens up school choice across the country,” said Mathew Staver, founder of Liberty Counsel, an Orlando, Florida-based conservative Christian legal firm that has filed a brief supporting the petitioners in both cases. “I see school choice as a reaction to the failed system in the public schools, which is failing both in academia but also failing in the sense they are pushing ideology that undermines the parents and their relationship with their children.”

    By taking the cases, the Supreme Court once again inserts itself in ongoing culture wars in the nation, which have been elevated by presidential orders threatening to take away funding if schools push diversity, equity and inclusion initiatives and state laws banning teaching on various controversial subjects. Legal scholars predict that the Supreme Court will lean toward allowing St. Isidore and the opt-outs for parents because of how the justices ruled in three cases between 2017 and 2022. In each case, the justices decided that states could not discriminate against giving funds or resources to a program because it was religious.

    Of the two cases, St. Isidore likely could have the greatest impact because it is attempting to change the very definition of a public school, say opponents of the school’s bid for charter status. Since charter schools first started in the 1990s, they have been defined as public and nonsectarian in each of the 46 state statutes allowing them, according to officials at the National Alliance for Public Charter Schools. Today, charter schools operate in 44 states, Guam, Puerto Rico and Washington, D.C., and serve roughly 7.6 percent of all public school students.

    “It would be a huge sea change if the court were to hold they were private entities and not public schools bound by the U.S. Constitution’s establishment clause,” said Rob Reed, the alliance’s vice president of legal affairs.

    A victory for St. Isidore could lead to religious-based programs seeping into several aspects of public schooling, said Steven Green, a professor of both law and history and religious studies at Willamette University in Salem, Oregon.

    “The ramification is that every single time a school district does some kind of contracting for any kind of service or curricular issues, you’re going to find religious providers who will make the claim, ‘You have to give me an opportunity, too,’” Green said.

    St. Isidore’s appeal to the Supreme Court is part of an increasing push by the religious right to use public funds for religious education, said Josh Cowen, a professor of education policy at Michigan State University and author of a 2024 book on school vouchers. Because of previous court decisions, several voucher programs across the country already allow parents to use public money to send their children to religious schools, he said.

    “What’s going to happen if the court says a public school can be run by a religious provider?” Cowen asked. “It almost turns 180 degrees the rule that voucher systems play by right now. Right now, they’re just taking a check. They’re not public entities.”

    The effect of a St. Isidore victory could be devastating, he added. “It would be one more slippery slope to really kicking down the wall between church and state,” Cowen said.

    Jim Campbell, chief legal counsel for Alliance Defending Freedom, which is representing St. Isidore’s bid to become a charter, discounted the idea that a St. Isidore win would fundamentally change public schools. Like Staver, he views St. Isidore as simply providing another parental option. “We’re not asking the state to run a religious school,” Campbell said. “These are private entities that run the schools. This is a private organization participating in a publicly funded program.”

    Opponents of religious charter schools question whether St. Isidore would have to play by the same rules as public schools.

    “How are they going to handle it when there’s a teacher who has a lifestyle that doesn’t align with Catholic school teaching? They’re talking out of both sides of the mouth,” said Erika Wright, an Oklahoma parent and plaintiff in a lawsuit protesting a Bible in the classroom mandate by Oklahoma’s state superintendent of instruction. She also joined an amicus brief against St. Isidore’s formation.

    “As a taxpayer, I should not be forced to fund religious instruction, whether it’s through a religious charter school or a Bible mandate,” Wright said. “I shouldn’t be forced to fund religious indoctrination that doesn’t align with my family’s personal beliefs.”

    Notably, in the Montgomery County parents’ case going before the court, parents use similar reasoning to support their right to opt out of instruction. “A school ‘burdens’ parents’ religious beliefs when it forces their children to undergo classroom instruction about gender and sexuality at odds with their religious convictions,” the parents’ brief said.

    The school district in 2022 adopted several books with LGBTQ+ themes and characters as part of the elementary language arts curriculum. Initially, families were allowed to opt out. But then the school system reversed its policy, saying too many students were absent during the lessons and keeping track of the opt-outs was too cumbersome. The reversal led to the lawsuit.

    Historically, school districts have given limited opt-outs to parents who, for example, do not want their child to read a particular book, but the Montgomery County parents’ request is broader, said Charles C. Haynes, a First Amendment expert and senior fellow for religious liberty at the Freedom Forum in Washington, D.C. The parents are asking to exclude their children from significant parts of the curriculum for religious reasons.

    “If the court sides with the parents, I think the next day, you’re going to have parents across the country saying, ‘I want my kids to opt out of all the references to fill-in-the-blank.’ … It would change the dynamic between public schools and parents overnight,” Haynes said.

    Sarah Brannen, author of “Uncle Bobby’s Wedding,” one of the LGBTQ+ books Montgomery County schools adopted, sees major logistical issues if the school system loses. “Allowing parents to interfere in the minutia of the curriculum would make their already difficult jobs impossible,” she said.

    Colten Stanberry, a lawyer with the Becket Fund for Religious Liberty representing the Montgomery County parents, disagreed. School systems manage to balance different student needs all the time, he said.

    A triumph for the Montgomery County families and St. Isidore would cause much more than logistical issues, said Becky Pringle, president of the National Education Association. It could lead to a public education system where parents can pick a school based on religious beliefs or try to change a traditional public school’s curriculum by opting out of lessons in droves.

    “For us to be a strong democracy, then we necessarily need to learn about all of us. To separate us flies in the face of why we were founded,” Pringle said.

    The Trump administration says one of its primary goals in education is to expand school choice and put power back in the hands of parents. Yet it has killed the main way to track one of the most rapidly growing options — learning at home. 

    The Education Department began counting the number of homeschooled children in 1999, when fewer than 2 percent of students were educated this way. Homeschooling rose by 50 percent in the first decade of the 2000s and then leveled off at around 3 percent

    The most recent survey of families took place in 2023, and it would have been the first indication of the growth of homeschooling since the pandemic. The data collection was nearly finished and ready to be released to the public, but in February, Elon Musk’s Department of Government Efficiency (DOGE) terminated the contract for this data collection, which is part of the National Household Education Survey, along with 88 other education contracts. Then in March, the federal statisticians who oversee the data collection and could review the final figures were fired along with almost everyone else at the National Center for Education Statistics (NCES). As things stand now, this federal homeschool data is unlikely to ever be released.

    “Work on these data files has stopped and there are no current plans for that work to continue,” said a spokesman for the American Institutes for Research, a nonprofit research organization that had held the contract to collect and analyze the data before DOGE canceled it. 

    The loss of this data upset both avid supporters and watchdogs of school choice, particularly now that some states are expanding their Education Savings Account (ESA) programs to transfer public funds directly to families who homeschool their children. Angela Watson, a prominent Johns Hopkins University researcher who runs the Homeschool Research Lab, called it a “massive loss.” Robert Maranto, a professor in the department of education reform at the University of Arkansas, said that in the past, the federal statistics have helped “dispel some of the myths” that homeschooling is “overwhelmingly white,” when, in fact, a more diverse population is learning this way. Maranto also serves as the editor of the Journal of School Choice. The most recent issue was devoted to homeschooling and about half the articles in it cited NCES reports, he said. 

    “There is a certain irony that a pro-school choice administration would cut objective data that might help increase acceptance of homeschooling,” said Maranto.

    It is unclear what will happen to the unreleased 2023 homeschooling data or if the Education Department will ever collect homeschool statistics in the future. 

    In response to questions about the fate of the homeschooling data, Education Department spokeswoman Madison Biedermann said that its research arm, the Institute of Education Sciences, is in possession of the data and that it is “reviewing how all its contractual activities can best be used to meet its statutory obligations.”

    Last September, the Education Department released some preliminary statistics from the 2023 survey. It noted a small increase in traditional homeschooling since 2019 but a large increase in the number of students who were enrolled in an online virtual school and learning from home full time. Together, more than 5 percent of U.S. students were learning at home in one of these two ways. Fewer than 4 percent were learning at home in 2019.

    Researchers were keen to dig into the data to understand the different flavors of homeschooling, from online courses to microschools, which are tiny schools that often operate in private homes or places of worship. Researchers also want to understand why more parents are opting for homeschooling and which subjects they are directly teaching their children, all questions that are included in the parent survey conducted by the Education Department.

    Tracking homeschooling is notoriously difficult. Families who choose this option can be distrustful of government, but this was one of the few surveys that homeschool advocates cited to document the growth in their numbers and they advised the writers of the federal survey on how to phrase questions. 

    Beginning in 2020, the U.S. Census Bureau also began collecting some data on homeschooling, but those statistics cannot be directly compared with the Education Department data and without a historical record, the census data is less useful, researchers said. It is also unclear if this census data will continue. Some states collect data on homeschooling, but researchers said they do it in different ways, making it impossible to compare homeschooling across states.

    Patrick Wolf, a professor of education policy who studies school choice at the University of Arkansas, was also dismayed by the loss of the Education Department’s statistics. 

    “A federal government agency has been collecting national statistics on education since 1867,” he said. “State and local policy makers and practitioners will be severely challenged in doing their work if they don’t have good data from the feds regarding public schooling, private schooling, and homeschooling. Sending education authority to the states only will work well if the federal government continues to collect and publish comprehensive data on schooling. Otherwise, state and local officials are being asked to fly blind.”
